Dear Ms. Dixon:
Pursuant to your inquiry of why D.H.H.S. would not issue a
Health Authority Approval until the septic system on the
subject property was brought into compliance with Municipal
Code is as follows.
An absorption trench with perforated pipe in it that is not
level may cause premature failure of the absorption trench. At
the time of failure, septic tank effluent could come to the
ground surface and flow to a nearby well, entering into the
water aquafer supplying that well and other wells in the area
causing a potential health problem. This is in addition to the
fact of the later discovered water line closer than the minimum
setback requirement from an absorption trench causing an
immediate health risk.

Enclosed please find the bill from Eight Star Construction
covering work done on Eagle River Valley Ranchetts, Lot 27C.
HUD sold this home in December, 1986. The home was sold as a four
bedroom. The septic system was not adquate for a four bedroom
home. Pat Brown was the contact person for HUD at that time.
It was agreed that tIud would escrow $3,500.00 for the upgrade of
the leach field from a 3 bedroom home to a 4 bedroom home. In
order to save money the work would be completed in the spring
and if more monies were needed BUD would furnish the funds.
In March,! contacted Eight Star Construction who had done
leach field upgrades for me in the past. Through Ak9~' Environmental
Control Services they proceeded to expand the system at the above
location.
The ground was removed and a new larger septic tank was placed
in the ground per engineers specs. The backhoe operator then
went to the end of the existing leach field and dug the proposed
extensions. At that time the operator examined the existing leach
field and it was found not to be level and was running uphill.
It was determined that sewage was not flowing properly. The engineer
was notified. The en~gineer then instructed the operator to level
the existing leach field. When the task was completed the leach
field was found to be 12 inches short of leach field rock. The
engineer was called again and he then instructed the operator to
extend the leach field for a second time. At this time, since
so much ground had been violated, the engineer instructed the operator
to locate the water line. The water line was ~ocated after m~ny
hours of searching. The waterline was difficult to find due to
lack of records and cooperation on the part of the community water
personnal . When locate(] and e×amined (due to the location waterline
was suspected to be in the direct path of sewer lines) the water
pipe was determined to haw. a joint existing in the pipe out:;ide

replaced with a 20 foot section of solid sewer pipe. To accomplish
this the sewer tank had to be removed and moved. Due to encroachment
of septic to water line an 8 foot section of existing leach field
had to be removed and replaced with virgin soils. To preserve
orginal landscape and prevent further cost overruns, the leach
field was redesigned again. Extension of the remaining leach field
was required due to water line location.
The leach field was extended again for a total of four unavoidable
redesigns of the leach field. It was then completed and filled
in and a final inspection by municipal officals was completed.
Owners, engineers and contractors stayed in constant contact.
No duplication of trips were logged. The engineer was often at
the site after 6:00 P.M. on his way back to Anchorage from other job
sites. Equipment was left at the site to avoid extra transporting
when delays were encountered waiting for the engineer, waterline
information and inspections. Numerous conversations were held by
phone at night with the owners by the contractor,land of course
by the contractor with the engineer. All of these efforts enabled
work to proceed during the day with little or no dead time being
charged. Ali parties worked toward a timly completion of project
with respect, for the cost overuns. No work was ordered or completed
that was not specifically called for in municipal or State Codes.

We have reviewed your letter regarding the subject property.
And in response thereto certain documents in our file have been
reviewed'. We propose that the contractual agreement form, HUD~
9548, Standard Retail Sales Contract, dated October 28, 1986,
between the U.S. Department of llousing and Urban Development and
the Combses was and still Is the controlling document to what we
agreed to do or not to do in this transaction.
I direct your attention to the contractual agreement cited
above: Under "Conditions of Sale" paragraph B., it specifically
states that "Purchaser will accept the property in the condition
existing on the date of this contract. Seller does not warrant
the condition of the property or compliance with code require-
ments and will make no repairs to the property after execution of
this contract". HUD subsequently agreed to correct deficiencies
at the location should the Department of Health and Environmental
Protection report show that the system is unsafe or hazardous.
The application dated January 5, 1985 was approved. The Depart-
ment of Health and Environmental Protection approved three (3)
bedrooms because that is what was asked for in the application.
It has never stated that the existing system was deficient or
inadequate, t
It is not known who concluded that the septic system was
inadequate. However, in good faith, HUD opted to escrow $3,500.00
to defray cost to the buyers should any deficiencies occur. HUD
did not commit itself to any cost above that amount. Therefore
IIUD does not assume any additional responsibility to this
property.

This lot consists:of a 4 bedroom home with on-site sewer and public water. In
1984, the sewer system was upgraded for 3 bedrooms. This upgrade has a total
absorption area of 600 square feet. The permit shows a soil rating of 166
sq.ft./bedroom. This would require 664 square feet of area for 4 bedrooms. The
trench contains 5 feet of gravel depth which would require an additional 6.5
feet of length. The existing septic tank is 1,000 gallon capacity. An
additional 500 gallon tank will be added. Refer to the attached diagram for
proposed upgrade locations.
On 12/11/86, an adequacy test was performed on the existing trench. 694 gallons
of water was introduced with no rise in the system. It is currently working
adequately for 4 bedrooms.
