The monitoring tube within the test hole has been checked and found to be dry. This property has enough area fora future septic upgrade which can be seen on the attached site plan. If you have any questions, or require additional information for your review, STRUCTURAL & MECHANICAL INSPECTIONS ON SITE WASTE WATER DISPOSAL SYSTEM DESIGN SU/Isu 17034 NORTH EAGLE RIVER LOOP · SUITE 204 · EAGLE RIVER, ALASKA 99577 ON-SITE WASTEWA TER DISPOSAL SYSTEM CONSTRUCTION PRACTICES and MA TERIAL SPECIFICATIONS REFERENCE: Sun Valley Heights Subdivision, Block 5, Lot 8 GENERAL: 1. The scope of this project includes the installation of a 1000 gallon septic tank and leachfield h'ench to serve the three bedroom residence located on the referenced property. The existing septic tank is to be excavated, pumped, crushed, and abandoned. Aisc the existing leachfield is to be abandoned in place. Construction shall be in accordance with the approved site plan and design drawings; Municipal permit with any special provisions or conditions; and afl applicable State and Municipal Wastewater Disposal Regulations. The contractor shall be responsible for obtaining any necessary underground utility locates, Unless specifically agreed otherwise, the property owner shaft be responsible for final grading areas subsequently depressed from soil settling, Contractors installing wastewater disposal systems must be certified by the Municipal Health Department for system installations. Owners installing their own systems must also receive prior approval from the Municipal Health Department. SEPTIC TANK INSTALLATION: A septic tank is to be constructed by a certified septic tank manufacturer. Construction shall include two 4" cleanouts for pumping access. The septic tank shall be sufficiently bedded to prevent settling or shifting of the tank. Aft standpipes on the septic tank shaft extend a minimum of 12 inches above final grade, Page Two Sun Valley Heights Subdivision, Block 5, Lot 8 October 9, 1993 Septic tanks installed with less than 4 fl. of cover shaft be insulated. A foundation cleanout shaft be installed one to four feet from the building foundation. In the line between the tank and the leachfield there shaft be two adjacent cleanouts (unless an effluent pumping system exists within the septic tank). These cleanouts shaft be located on undisturbed soft not more than 10 fl. from the tank. The first oleanout, in line, shall be to clean toward the leachfield. The second cleanout shaft be to clean toward the septic tank. Final grading over the septic tank shaft be such that a positive slope exists away from the septic tank. AB$OFIPTION TRENCH/DRAINFIELD INSTALLATION: Excavate the proposed trench to the dimensions shown on the design. The bottom of the excavation shaft be within 2 inches of level. If the sidewalls of the excavation become smeared, they must be raked or scratched (ruffed-up) before gravel (sewer rock) placement. Once the gravel is installed, the distribution pipe/s to be installed level with the perforations faced downward. Gravel is then to be placed over the distribution pipe to provide a minimum of 2 inches of cover over the pipe. A silt barrier must be installed between the final gravel/aye/' and the native soil backfill. Ensure the silt barrier covers the entire gravel surface before placing backfill. Monitor tubes shaft be of four (4) inch diameter and installed approximately in the locations shown on the design. The port/on of the monitoring tube extending through the gravel shaft be perforated from the bottom of the trench to the invert of the distribution pipe. This is equivalent to the effective depth of the gravel as noted on the design. Backfill over the final gravel layer must not be less than twenty-four (24) inches. Insulation must be installed when the backfill depth is less than thirty-six (36) inches. The finish grade over tile trench must be mounded to prevent the formation of a depression after settling. Page Three Sun Valley Heights Subdivision, Block 5, Lot 8 October 9, 1993 MINIMUM MA TERIAL SPECIFICATIONS: Any septic tank proposed for installation must be constructed by a Municipally approved septic tank manufacturer. Insulation shaft be at least 2" thick extruded direct burial polystyrene (Dow Chemical Company Styrofoam HI or equal). Septic tank inlets and outlets shaft be fitted with watertight couplings (Caulder, Femco, or equal). A permeable nontoxic silt barrier (Typar 3401, Mirafi 140N, or equal) must be installed between the final leachfield gravel layer and the native soft backfill. Aft leachfield gravel (sewer rock) shaft be 0.5"-2.5" screened gravel with less than 3% passing the #200 sieve. When sand is being used as a filter material, it's gradation specifications must conform to current M.O.A, or D,E.C. requirements. Page Four Sun Valley Heights Subdivision, Block 5, Lot 8 October 9, 1993 INSPECTIONS: Typically there will be a m/n/mum of three (3) inspections required during lhe installation of the wastewater disposal system. These inspections will occur as follows: The first inspect/on must be conducted after the excavation of ditches, pits, trenches, or beds and before the installation of any gravel. A septic tank may be set in place, but may not be backfilled before this inspection. The second inspection must be conducted after the placement of the s/it barrier, gravel, distribution lines, standpipes, cleanouts, and insulation, but before the placement of any other backfill. 3. The final inspection is to occur upon final grading of the property. Often there will be more than these 3 inspections required. Especially with the installation of multiple trenches, sand filters, pressurized distribution systems, etc. Thus, the inspecting engineer is to be contacted at least 24 hours prior to the start of construction. The Department of Health and Human Services is willing to consider some of the remedies outlined in your letter, however, the method of proposing the upgrades is through the standard On-Site Wastewater System Disposal Permit. Any waiver of the permit fee must be obtained through the Anchorage Municipal Assembly, for municipal staff do not have the authority to waive or alter fee structures. This section would also like an expedient solution to this situation, and will review your permit submittal in as timely a manner as possible. It appears that a portion of the existing soil absorption system is installed next to unacceptable soils, littered with construction debris. That same portion is installed closer than 50 feet to a downhill, man-made break in the slope of the terrain, where the slope is greater than 25 percent. I feel your requirement that the existing on-site soil absorbtion system be abandoned in its entirety and replaced with a new system, should be reconsidered. I propose that the first 30 feet of the on-site soil absorbtion system be abandoned. I will redig the trench, remove the perforated pipe and excavate the gravel. The trench will then be backfilled and compacted in 2 foot lifts. Solid pipe will then be J. nstalled from · the tank to the 30 foot station and backfilled to ground level with native soil. The drain field will then be extended 30 feet and the required silt barrier, cleanout and groundwater monitoring tubes installed. This proposal will address both the slope and construction debris problems. In regard to obtaining a new permit to begin repairs, I submit that the system was installed in a timely manner and were it not for bureaucratic delays of your office and the State of Alaska I could have remedied any problems well within the timeline of permit ~SW930477. I, the homeowner, propose to complete the above repairs, myself, under the direct supervision of Mr. Tobben Spurkland, P.E., registered engineer of the State of Alaska. Your department will be notified prior to inJ_tiating any repairs, to enable you to perform any necessary field J_nspections. Kleweno, P.E. regarding the site visit and test holes excavated on Lot 8, Block 5, Sun Valley Heights. Mr. Kleweno listed specific requirements of 18 AAC 72 which this system does not meet. Specifically: 1. "During the excavation of test holes 1, 2, 4, and 5, concrete blocks, wires, sections of pipe, visqueen, and rebar were encountered in all four test holes. Test holes 1, 2, 4, and 5 revealed that a portion of the soil absorption system was installed in soils that can not be classified as GW, GP, GM, SW, SP, or SM under the Unified Soil Classification System as referenced in 18 AAC 72.950(16) nor does the material encountered during the excavation of the four test holes meet the requirements of 18 AAC 72.270(8) and (10)." 2. "It also appears that hole 1 of June 23, 1995 was excavated in the same location as the test hole you excavated on July 7, 1994 as noted on the site diagram submitted to the Municipality of Anchorage on August 29, 1994. Your soil logs dated Jtdy 2, 1994 show 'sandy silt - MS' from surface to 11.5 feet which is dramatically different from what was observed and witnessed by you in (the) test hole of the June 23, 1995 excavation at the same location. 3. "Based on the infonmation gathered during the excavation of the five test holes, it appears that a section of the existing soil absorption system was installed closer that 50 feet to a downhill man-~nade break in the slope of the terrain where the slope is greater than 25 percent. This is a violation of 18 AAC 72.025(b)(1)(E). Mr. Tobben Spurkland, F.E. August 1, 1995 Page 2 For this on-site system disposal field to meet the requirements of 18 AAC 72 and AMC 15.65 and for the requirements of the Conditional Certificate of Health Authority on this property to be removed, the following must be accomplished: 1. The existing on-site soil absorption system must be abandoned and replaced with a system similar, to the design of permit No. SW930477. 2. Due to the fact that permit No. SW930477 expired on 11/12/94, a new permit must be obtained prior to this replacement. 3. A Municipality of Anchorage approved excavator must install the replacement system, after approval of a permit design. If you have any questions on the above matter, please call me at 343-4744. Box 196650 Anchorage, Alaska 99519-6650 August 1, 1995 Mr. John Clark Division of Occupational Licensing 3601 C St., Suite 722 Anchorage, AK 99503 Dear Mr. Clark: I have enclosed a package of information regarding an on-site wastewater disposal system constructed on Lot 8, Block 5, Sm~ Valley Heights, in Anchorage. This system, as installed, was designed by Tobben Spurldand, P.E., and installed by the homeowner. The property was issued a permit by the Department of Health and Human Services (DHI-IS) to install an on-site wastewater disposal system on November 12, 1993, based on a design submitted by S & S Engineering in Eagle River. (See attachment "A", and note the clause stating: "All construction must be in accordance with: 1. The attached approved design...") On August 30, 1994, Mr. Spurldand submitted an As-Built Inspection Report for a system installed on this property. The report stated: "System redesigned and relocated." (See attachment "B") After review of the as-built inspection report, and a site inspection of the system, it was determined that this system was installed in violation of Anchorage Municipal Code (AMC) 15.65, Wastewater Disposal Regulations. The violation was of section 15.65.060.A.l.b, which states: "A subsurface disposal field may not be located less than: 50 feet uphill from any man- made or any natural break in the natural slope of the terrain where the slope changes to 25% or greater unless the top of the drain field is lower in elevation than the toe of the slope." It was determined by field measurements that this system was in part less than 30 feet from a slope in excess of 25%. Mr. Spurkland was issued a citation, for this violation, and the case was heard in Magistrates Court. Mr. Spurkland's lawyer argued that the code referred only to natural breaks in the slope, and that this steep slope was made entirely of fill. This Department did not have the soils information to dispute this claim, for our interpretation was that the code referred to both man made and natural slopes. The Magistrate found Mr. Spurldand not guilty of the violation. Due to the fact that the Anchorage Municipal Code refers to the State of Alaska 18 AAC 72, Wastewater Disposal Regulations, this system was referred to the Alaska Department of Environmental Conservation (ADEC) for review. Mr. Spurldand wrote a letter to ADEC on January 19, 1995, requesting a waiver from the setback requirement. Mr. Kevin Kleweno, P.E. responded to this request on June 9, 1995 (see attachment "C"). He stated that a minflnum of two additional test holes must be excavated, and must be coordinated with ADEC. A total of five test holes were excavated on June 23, 1995, with Mr. Spurkland and Mr. tGeweno present. Mr. Kleweno noted his determinations in a letter to Mr. Spurldand dated July 5, 1995 (see attachment "D"). This letter states that the test holes encountered: "concrete blocks, wires, sections of pipe, visqueen, and rebar." Mr. tGeweno also determined that the system was in part installed in the soil or fill encountered in four of these test holes, which was in violation of 18 AAC 72. Mr. Kleweno also determined that a test hole excavated in the same location as a 'test hole logged by Mr. Spurkland on August 29, 1994 contained this same "concrete blocks, wires, sections of pipe, visqueen, and rebar". Mr. Spurldand's soils log, which he stamped and signed on July 7, 1994, stated that the soils were "sandy silt - MS". (See attachments "E" and "F"). Mr. Kleweno also determined that the system was in part less than 50 feet from a man-made slope greater than 25%, and that the system would not qualify for a waiver from this requirement of 18 AAC 72. Mr. Kleweno then referred Mr. Spurldand to the DHHS for resolution of the matter. During the excavation of test holes 1,2, 4, and 5, ~norete blocks, wires, ~ections of pipe, vl~ueen, and rebar were encountered in all four' test hol~, 'rest holes 1, 2, 4, and 5 revealed that a portion of the soil absorption system was Installed in soils that can not be classified as GW, GP, GM, SW, SP, or SM under the Unified Soil Classification System as referenced in 18 AAC 72.950(16) nor does the material encountered during the excavation of the four test holes meet the requirements of 18 AAC 72.270(8) and (10). It also appears that test hole I of June 23 was excavated in the same location as the test hole you excavated on July 7, 1994 as noted on the diagram submitted to the Municipality of Anchorage on August 29, 1994. Included in the irrformation you provided is a letter dated January 19, 1995 from a T. Spurldand, P.E. requesting interpretation of 18 AAC 72.025Co)(1)(F) and the need for a waiver, Based on the information there is also a question on the type of soils located in and around the soil absorption trench designed by Mr. T. Spurldand, P,E,, This certainly impacts any decision on a waiver, so lets deal with it first, A letter from S&S Engineering dated September 5, 1994 staIa:s that they excavated a test hole in the general location of a soil absorption trench that was installed by T, Spurkland, The S&S test hole was dug to a total depth of approximately 9 feet below groined surface:. It found (remove this "fill") soils to be fill, containing concrete and rebar. It also eneomttered pooling septic system effluent at 6 to 9 feet below the surface, The S&S test hole did not encounter undisturbed native sot1 suitable for treatment of septic system effluent, On August 29, 1994 Test holes # 1 and #2 were dug by T. Spurkland near thc location of the soil absorption trench referenced above. Soil logs and percolation tests were submitted for these test hole in their On-Site Wastawater Disposal System and/or Well Inspection Report dated July 7, 1994 and finalized August 22, 1994. The soil log for test hole #1 identifies the presence of a uniform layer of sandy silt starting from the surface of the ground to 11.$ feet below the sm'face, The soil log states that no dated July 7, 1994 and :~'inalized August :Z;1, 1994. The soft log for test hole #1 identifies the presence of a uniform layer of sandy silt starting from the su~.aee of the grourtd to 11.$ feet below the surface, The soft lo,g states that no ground water was encountered in this test hole. Test hole/f2, identifies tho presence of approximately 1,$ feet of uuidantifled fill covera the natural ground surface at its location. TI'ds soil log also indicates the presence of a uniform layer of sandy silt starting approximately 1,5 feet below the surface to a depth of 17 feet below the surface. The log states that no ground water was eneouutered in thts teat hole, The soft log for test hole ,¢2 reporta a percolation test rate of ;tO minutes per inch. The percolation test being run at between 8 feet and 8.5 feet. In a letter dated January 19, 1995 from Mr. T, Spurkland, P,E., ADEC is asked for an interpretation of 18 AAC 72 concerning tho need fox' a separation distance waiver for ~l slopes greater than 25% when the domestic wastewater system has been installed below original ground surface having a slope of less than 25%. Mr. Spurlfland'a letters states that lot development placed ~l downhill from the location of the soft absorption trench, creating a steeper slope at the natural grade, break, from the top of the fill to its intersection with the nalural slope. This letter does not say wbea the fill material was installed. I do not have, a copy of any MOA~ DlCII-I~ review of this so my comments are, re,stricted to the above. #1. Soil type and ground water elevation There appears to be a significant d~ffe,rence between what S&S and T. Spm'ldand report on soQ types and ground water depths near the new soil absorption trench, A review of additional information finds that an earlier test hole was (lug in ~ts lot back in August 1986. That test bole was located approximately 190 feet southe,ast from test hole #1. Its soils log identified a mixture of soils to a depth of between 7 to 8 feet and states that no ground water was encountered, l~rom the above I will assmue that native soils may frequently change on this lot. I wiU therefore disregard the information provided by test hole dug in 1986 since its far from test hole #1. A possible explanation fox' the difference betwee,n the test holes dug by S&S and T. Spurkland may be that, despite being located near the soil absorption trenoh, $&S'a test hole was placed above the fill This would help e,xplnin how information provided by both S&S and T, Spurkland may be accurate,. However, it also rases a concern that a portion of the new soil absorption trench may be located in unacceptable fill material, not native soil, #2. Waiver Request T. This statement must also indicate that there was no sign of iill, construction debris, septic effluent or ground water in the area of the trench to receive the gravel layer. A statement, bearing your original stamp and signature, indicating that you used sound engineering practices to determine that the existing, abandoned trench is a minimum of 12 feet (two times the effective depth of gravel of 6 feet) from any portion of the new trench constructed under DHHS permit #SW930477. The conditional approval also stated: "conditional approval pending upgrade of old septic for orig. 8 br. house and studio. S&S Engr. design dated and revised 10/21/93." The as-built inspection report, dated 8/22/94 states: "system redesigned and relocated". A review of this inspection reportwhich you submitted, shows that the system was not installed according to permit No. SW930477. This clearly did not satisfy the requirements of the original conditional health authority approval. 2. Permit NO. SW930477 states: "ALL CONSTRUCTION MUST BE IN ACCORDANCE WITH: 1. THE ATTACHED APPROVED DESIGN. 2. ALL REQUIREMI~INTS SPECIFIED IN ANCHORAGE ML~ICIPAL Agaflb the as-built inspection report dated 8/22/94 shews that the system was not installed according to the approved design of the permit. 3. A field inspection conducted by On-Site Services Personnel indicated that the disposal field was installed approximately 29 ft. from an existing slope in excess of 25%. AMC 15.65.060.A.l.b states: "A subsurface disposal field may not be located less than 50 feet uphill from any man-made or any natural break in the natural slope of the terrain where the slope changes to 25% or greater..." Also, AMC 15.65.040.A states: "...an on-site wastewater disposal system must conform to the standards in this Chapter, 18 AAC 72 and to ...'. In the event of inconsistency among these regalations and standards, the more restrictive shall apply. 18 AAC 72.025.b.l.E.ii states: "the distance from any part of a soil absorption system to downhill man-made or natur,-fl breaks in the slope of the terrain where the slope becomes greater than 25 percent must be at least 50 feet." This system does not meet the clear requirements of 18 AAC 72.025.b.l.E.ii. 4. As you are aware, an Health Authority Approval states: "...the on-site water supply and/or wastewater disposal system is in compliance with all Municipal and State codes, ordinances, and regulations in effect on the date of tigris inspection." The Department of Health and Human Services will not issue an unconditional Health Authority Approval on this property until this system is in compliance with all required codes, ordinances, and regulations. Ivh.. Collin had recently bought this property and needs a Certification from the Health Depart~nent that his system is in compliance with Municipal and State regulations. The fiuancial transaction with the mm'tgage company can not be finalized until this certificate is obtained. On the 27th. of August I prepared the paperwork required to obtain the certificate. I was subsequently served with a citation of four code violations regarding the installation of this septic system. I was also served with a citatinn of three code violations in June with regard to a different septic system. I contested the allegations of the Health Department and itl a hearing before a Municipal Magistrate on November 25 and 28 1 was found not guilty of all seven allegations hr the two citations. I expected that the court hearing would be tile end of this matter, and requested an Health Authority Approval from DHHS. I received an conditional approval, with a very vague statemeut that ADEC should be contacted to determine if this system is in compliance with State Regulations. The conditional approval implied that the system may not be in compliance with 18AAC 72. No specific references to subsections of 18AAC 72 were given. I bare been under the impression that one of the obligations of the Health Department was to euforce both the Municipal and the State regulations governing septic systems serving single family residences. 15.65.010 Definitions definition L ""Health Authority Certificate" means a written confirmation signed by an engineer and the Department certifying that the on-site sewer and water system serving a single family dwelling is functinnal and complies with all state and local regulations and codes; in the event of inconsistancy among these regulations and codes, the most restrictive shall apply." By issuing a conditional HAA for this property you are stating that you are unable to determine if this system meets State regulations. This is an indication that you are not qualified for your position and that nobody within the Depat~nent is able to determine if this system is in violation of specific requiremants of 18AAC 72. If this is so, the ordinance which delegated the responsibility for single family septic system compliance review to the Monicipality must as well be repealed and the authority returned to ADEC. From your actions in this matter it appears that you and the Department are deliberately harassing me by bureaucratic nitpicking and unwilliugness to accept the validity of opinions contrm3, to your own. If this situation continues I will be filing a cmnplaint with the Municipal Ombudsman and will take any other step necessary to ensure that this unwarranted activity by your department is stopped. Your actions are causing my client inconveniences and me grief and economic loss. S & S Engineering designed an on-site wastewat~ disposal system for the referenced property· It is our understanding from Tobben Spurkland's letter that the property own~ installed the septic system and contracted with Tobben Spurkland to perform installation inspections. The system instat~ed deviated substan~ally from our design and specifications. Since S & S Engineering was not the owner's representative and did not inspect the installat~;on of t--~e system, we shall have no liability to the owner or to others for act~ or ommissions of the owner/contractor or any oth~ persons performing work on th~ project, or the fa~ure of the own~r/contactor to carry out the work in accordance with our construction documents. The following noted discrepancies either ,¢u~e documented or appear to exist between the proposed system design by S & S Engineerin~ and the system actually installed under the direction of Tobben Spurkland in Ju~,y of 1994: S ~ S Engineering excavated a test hole in the general location of the new trench that was installed by Mr. Spurkland. T~is test hole revealed the soils to be fi~l, cont~ning concrete and reb~£. Pooling septic system effluent was noted between 6' and 9' below the ground surface. The water line was not observed during excavation however it appears from the as~bu~3et submitted by Mr. Sparkland that a water line may be located with less than a 10' separation d~tance between the water line and the newly installed septic system. Al~o from Mr. Sparkland's as~built it appears that the new trench may be less than the required 50' horizo~tat separation distance to a steep slope located on the west side of the trench area. 4. It appears that the newly instated t~ench may have been installed through or in close proximity to the old septic system installed in 1971. I do not agree with Mr. Spurkland's conclusions that the septic system could not have been installed in the location shown on S & S Engineering's drawing. The existing septic tank ms over 20 ye~s old and it was assumed in our design that the tank would have to be replaced. A new tank location was chosen and would have provided adequate vertical distance to obtain minimum slopes. Mr. Spurk~nd a~o excavated 2 additionat test holes on the property when the septic system was installed. If he was concerned with the ~levation differences, one of these test holes co~ld have been dug in the generat vi~ity of the proposed trench as required under the special provisions of the permit. When this test hole was excavated it could have been excavated to a depth of 16~' to 17', allowing a greater depth of the designed trench. Th~ would appear to have been a more suitable alternative than pla~ing a new septic system in an ~ea that is unsuited for that p~pose. S & S Engineering's design placed the trench in an area located 50' plus from the steep slope to the west and w~ designed to be instatled in undisturbed native soils. There was no possibility of the proposed trench encroaching upon the water line serving the studio nor would the trenc~ have, encroached upon the old existing system. The location of the trench was approximately 100 feet fi'om the existing septic tank. During a field inspection it became obvious that the suggested design could not be followed. Using the finished floor in the studio as an elevation reference of 100.00 ft, the existing t~mk inlet was found at elevation 94. The ground level at the proposed septic system location was 96. With a run of 100 feet at 2% the minimum tank inlet elevation would be 92 feet and the outlet 3 inches below this elevation. The approved design was based on 2 feet of cover over the trench, not 4 plus as dictated by surface topography. It was decided to relocate the system to the area northwest of the studio and residence. Two testholes were excavated to verify the soil conditions as reported by S&S. The results are included with this submittal. No evidence of the original leachfield was observed during the excavation of the new septic system.
