He has asked that this well be documented with the MOA now that the MOA regulates it. Here are the documents for this property. Very little is known of the septic systems on this property. I attempted to document them as much as I could without destructive inspections. Some of these septic systems will be regulated by the MOA, others will be regulated by the ADEC. If it serves less than 25 people, I believe the DEC would consider it a private well but I would recommend you confirm that with them. Since the former Class C wells are now called private wells, the required separation distances are the same as the private wells that we have jurisdiction over. If DEC confirms that they would consider this a private well, then at this time nobody is regulating the well. That being said, all wells are still required to be drilled per code. So I always tell people who are drilling one of these wells that they better do it to code because if the MOA were to start regulating these wells we could make them bring it up to code at a later date (i.e. at time of COSA). I am slowly working through my e-mails that I received while I was out of the office last week. Is this the same property that you e-mailed about last Tuesday (attached)? It was discovered that the well on this property is not a drilled well, but a shallows urf ace well. The homeowner is electing to drill anew well on this property. Would I need to seek a permit from MOA, or is this outside your jurisdiction? This well will serve 24 people, (12 bedrooms). I believe this is what the DEC now calls a private water system, or what was a class C well. What is the protection radius on this type of well? See attached survey of this property and a site plan showing a potential well location. Therefore, we would require a COSA for the septic serving the two single family homes and we would treat the well like a former Class C well, which only requires water quality testing for total coliform, nitrates and arsenic. Matt Baxter had indicated that the buyer would like both septic systems and the well tested. We cannot require anything besides what is stated above, but if the buyer is making that a condition of sale, then that is between the buyer and seller and we would review the results and provide comment if that information is provided on the COSA.
