Box196650 Anchorage, Alaska 99519 Gentlemen: February 28, 1997 S.14 O ( 3 RE: Plat S-10013 S9 7 s 1 7 This letter constitutes an appeal of the conditions of plat approval which was made on the above plat on February 10, 1997. The appeal concerns # 2 which requires the construction of East 112th Avenue. All three of the lots have existing access from Shady Lane and or 112th Avenue portions which are already constructed. In addition, all of the surrounding land in all directions is already subdivided to the smallest possible size allowable under the zoning, and all have access on existing roadways. None of the neigbors nor ourselves want to have 112th Avenue built, though we recognize that the easement exists for its eventual construction if it is ever needed. To require construction of that road is too heavy a financial burden for this platting right and should not be a requirement. At the hearing I intend to present testimony from neighbors relative to the roadway and facts relative to the need for the road. Requirement 8 is also being appealed in that all of the properties along Shady Lane have been built out, and the section of Shady lane between lot 27 and Jerome Road is the same narrow width as the section you are requesting additional right of way. Since the initial section of the road will never be widened as the properties are too small to be replatted, requiring an additional 30' of right of way from my property is unreasonable and unnessesary. At the hearing I also wish to discuss requirement 7 since I had already advised the building department that the cabin shown is a 1950's vintage log cabin used for storage, and has no heat, water or sewer, and has not been lived in for decades. The other accessory building on the site is presently under construction and is a hobby, shop, and storage structure, certainly permitted under the zoning or they would not have given me a building permit.
