The borough has refused to give its approval because the premises are served by seepage pits in violation of state and borough law, and the source of water does not comply with the Alaska Administrative Code as enforced by both the state and the borough. 7 Alaska Admn. Code, Div. 1, Ch. 2, Sec. 231(b) defines a "semi- public water supply" which applies to the well and distribution system serving the subject premises. Sec. 265 of the same chapter sets forth the minimum distances which drain fields, seepage pits and cesspools must be from the well and pipes. It appears as if the semi-public water supply serving the subject lots is Class A, having a pumping rate of 0.50 gallons per minute. From an inspec- tion of the premises, it appears as drain fields and cesspools or seepage pits are within the prohibited minimum distances to the well and water distribution system. Further, the premises are not served by septic tanks or an outfall sewer system. Sec. 9-71(B)(2), Code of Ordinances, Greater Anchorage Area Borough, requires a septic tank for the subject premises. the Alaska Administrative Code also requires a septic tank.
