ASD wanted the additional land to meet the requirements for a joint middle and elementary school site. The requested parcel was Lot 1, Kincaid West Subdivision and the improvements on the property included a residence that was built in the mid-1960s with an on-site well and septic system. The property title was conveyed on September 4, 2007 and after the real estate transaction was completed, ASD requested the house be demolished. A Hazardous Material Survey Report was commissioned and completed, identifying the need to abandon the existing well and septic per ADEC requirements. In 2009,the municipal Project Management and Engineering Department assisted the with the demolition contract using one of their term contractors, Renegade Equipment, LLC, who further sub-contracted the demolition to Alaska Demolition. The contract contained demolition, removal, and disposal of the septic tank and drain field system, along with well abandonment. In researching the documentation of the well abandonment and septic removal,we were able to find the attached documents and photos, but no formal documentation or certification of the work that was completed. With the lack of certifications or documentations, the Municipality of Anchorage proposes the following process during clearing, grubbing or other site work that would anticipate development of the property: During site work, if the subject well casing is located, the well will be inspected by a municipally certified well driller/pump installer for code compliance regarding decommissioning wells. Box 196650, Anchorage,AK 99519-6650 4700 Elmore Road,Anchorage,AK 99507 Phone(907)343-8135 Fax(907)343-8088 www.muni.org Daniel A.Sullivan,Mayor December 21, 2009 Memorandum of Understanding Between Municipality of Anchorage Departments Project Management & Engineering and Heritage Land Bank Regarding Building Demolition Work in Coordination with Muirwood Area Storm Improvements (PM&E No. 06-37) This Memorandum of Understanding shall serve to iterate an understanding between the Municipality of Anchorage Department of Project Management and Engineering (PM&E) and Heritage Land Bank (HLB) regarding building demolition work to be completed on Municipality of Anchorage (MOA) property managed by HLB adjacent to the project limits of the PM&E project identified as Muirwood Area Storm Improvements (PM&E Project No. 06-37). Project Background and Need: During the construction of PM&E project in 2009, PM&E began discussions with HLB about a vacant house located on the property at 6220 West 801h Avenue, Anchorage, Alaska with legal description Kincaid West, Lot 1. The house was constructed in mid-1960s and became vacant when HLB purchased the property. The vacant house is considered a liability to the MOA because the unoccupied structure could attract vandalism and become a public hazard. The PM&E storm drain project cleared trees within the right-of-way that is adjacent to the property, thereby enabling further public access to the house. PM&E and HLB agreed that it was in the best interest of the MOA to demolish the building and to expedite the work under the PM&E project construction contract. As anticipated, the Anchorage School District (ASD) obtained management authority from HLB on December 21 , 2009 . PM&E agrees to coordinate directly with HLB for the reimbursement of cost of the building demolition work (Work). Project Scope of Work: PM&E agrees to manage the Work related to the building demolition on subject property. The Work includes administration of professional services for obtaining hazardous materials survey report (Report); and contract administration for construction contract of the Work. The Report was prepared by EHS-Alaska, Inc on 10/27/09. The demolition work was negotiated as a contract change order by the construction contractor, Renegade Equipment, LLC, who is contracted for the storm drain project. Memorandum of Understanding Between PM&E and HLB Regarding Building Demolition Coordinated with PM&E Project No. 06-37 Page 2 of 3 The scope of work includes: • demolition, removal, and disposal of: potentially hazardous containing materials (as identified in the Report), all building materials associated with the building infrastructure, and septic tank and drain field system; • well abandonment; • backfill of areas from basement and wastewater system; and • decommissioning of utility services. PM&E has reviewed the Renegade Equipment, LLC (RE) cost proposal to RFP No. 1 to complete all work associated with demolition of the building. PM&E shall pay RE a lump sum amount of $44,530.00. The work shall be in accordance with the Hazardous Materials Report dated 10/27/09. Project Cost Information: The total project cost estimate is shown in Table 1 below. As previously discussed and agreed, HLB will reimburse PM&E actual costs, not to exceed $50,000. PM&E will pay all costs that exceed $50,000. PM&E will also pay all labor costs for construction administration and inspection of the Work. PM&E's cost participation is justified due to the fact that the Muirwood Storm Drain project significantly increased visual and physical access to the abandoned building thereby creating an attractive nuisance and associated risks. Demolition of the building is in the best interest of the MOA. Table 1. This project is located at 6220 W. 80th Ave, Anchorage, Alaska 99502. Legal description: Kincaid West, Lot 1. This Contract shall be for hazardous material abatement work, demolition and removal of the existing residential building structure of approximately 2422 SF with attached garage of approximately 483 SF; removal of exterior deck and porch support foundations, removal of downed wood fencing at north property line, removal of steel piping and footings west of the structure, abandonment of well and septic per ADEC requirements, backfilling and compacting crawispace/foundation with Type 3 material or better. All building concrete slabs, walls, footings, and footing pieces, driveway and sidewalk are to be completely removed from the site. 3. Bidders are specifically cautioned to visit the job site before submitting their bid to assure themselves of the conditions as they exist and verify the quantity and nature of the work. Any discrepancies between the conditions existing and those herein specified must be reported in writing before the proposal due date. The Municipality of Anchorage is not responsible for any discrepancy not so reported. 4. Prior to any demolition or abatement work, the Contractor and the Contract Administrator shall jointly inspect the properties. The Contract Administrator will photograph the entire site. The purpose of the inspection is to fully document the condition of the site and to identify any property to remain that may have sustained damage by Contractor by demolition activities. 5. All items,junk, debris, property, etc. not specifically identified by the Contract Documents shall be the responsibility of the Contractor to load, transport, unload and dispose of in a legally acceptable manner. The property, when completed, shall be left in a nuisance free condition. Unless provided for otherwise in a specific bid item, the cost for removal and disposal of junk, debris, property, items, etc. shall be incidental to the project and shall not be paid for separately. Trees may be removed as needed for demolition and site access. 6. Upon receipt of a Notice to Proceed, the Contractor shall obtain a demolition permit from the Municipality of Anchorage (MOA), Building Safety Division, 4700 Elmore Road and provide all required notifications to Municipal, State and Federal Agencies. 7. The Contractor shall contact all appropriate utilities (CEA, Enstar Gas, GCI, ACS, etc.) to notify them of demolition activities and verify all utility services have been disconnected according to the applicable utility company requirements. Power and gas service disconnections have already been requested of CEA and Enstar Gas. 6220 W.80th Ave. Demolition Statement of Work,October 29,2009 Page 1 of 2 8. Hazardous materials abatement is required. See EHS-Alaska, Inc. Hazardous Materials Survey Report dated October 27, 2009. The Contractor shall commence with the abatement in a manner approved by ADEC, OSHA, EPA, and any other federal, state, or municipal agencies, laws, ordinances and regulations. If prior approval is required by any agency of competent jurisdiction, the Contractor shall first notify and obtain approval from that agency. A copy of any notices, approvals, recommendations, or other information required by any agency shall be filed concurrently to the Contract Administrator with corresponding response(s)from that agency. No hazardous abatement work shall occur without prior approval from the governing agency. All costs associated with this requirement are incidental to the project. If any hazardous materials are discovered within the project limits,which have not been identified in the Hazardous Materials Assessment for this Contract, Contractor must immediately stop all Work and notify the Municipality of Anchorage in writing, so they may determine the appropriate action for the removal and disposal of any hazardous or contaminated materials. Contractor shall provide to the Construction Manager, copies of all the documentation produced when the encountered hazardous material is disposed of.The successful contractor shall be required to coordinate with Solid Waste Services for their requirements for accepting any hazardous materials. 9. Upon agency approval, the Contractor may commence with all hazardous abatement work necessary in accordance with the issuing agency's requirements. 10. The Contractor shall implement pollution prevention controls as necessary to keep all demolition water runoff from leaving the site. Roadway surfaces shall be kept clean during all hauling activities. 11. The Contractor is required to secure the site if property is left unsafe by demolition when site is unattended. No separate payment shall be made for securing the site. 12. If required, the Contractor is responsible for any and all on-site snow removal or clearing, necessary to perform the work. The Hazardous Materials Survey Report for the proposed demolition is included with these Contract Documents. 1.02 USE OF INFORMATION A. The Hazardous Materials Report is provided for the Contractor's information and use in the planning and performance of work in areas containing hazardous or potentially hazardous materials as outlined in Paragraph 1.03. 1. The information provided in the Hazardous Materials Report is based on samples collected in various locations of the building. Thus, the Owner and/or its Representative cannot guarantee or warrant that actual conditions encountered might not vary from the information presented in these reports. 2. The data reported in the Hazardous Materials Report is accurate to the best of the Owner's and it's Representative's knowledge. The requirements contained in these specifications and in the relevant state and federal regulations pertaining to the performance of work in areas containing hazardous or potentially hazardous materials provide guidance for the contractor for performance of work in these areas. The Owner and its Representative disclaim all responsibility for the Contractor's erroneous conclusions regarding the information presented in these reports; the requirements contained in these specifications; and the requirements of applicable state and federal regulations pertaining to performance of work in these areas. 3. The Contractor shall be responsible for obtaining additional information if Contractor deems it necessary to carry out the work. B. It is highly recommended that the contractor visit the site to acquaint themselves with existing conditions. C. Attached Hazardous Materials Survey Report 1.03 NOTIFICATION OF POTENTIAL HAZARDS A. Asbestos, lead and other hazardous materials are present in the building that may impact the work of all trades. Regulated air contaminants, including asbestos and lead, are assumed present in settled and concealed dust in and on architectural, structural, mechanical and electrical components or systems throughout the building. All trades shall coordinate with other trades and conduct their work to prevent worker exposure or site contamination. Refer to Division 13 specifications for specific information concerning disturbing, removing and disposing of these materials and the installation of new materials or components. This notification is provided in accordance with EPA and OSHA requirements. The future subdivision will be called Kincaid West and this parcel will be' come Lot 1. We are therefore requesting a permit be issued for the construction of a new septic system to serve the five-bedroom home on the lot. The attached Site Plan and backup documentation identify the location and configuration of the existing and proposed septic system. Also identified on the plans are the locations of the existing well. The new subdivision will be served by a community water system and no conflicts exist between the proposed septic system and existing well and those on adjacent lots. Drainage arrows and contour lines are shown indicating the current drainage patterns. The drainage patterns will be maintained after construction. The existing septic tank and absorption trench will be pumped, crushed, backfilled and abandoned in place. The test hole placed on the lot indicated poorly graded gravel with varying amounts of sand in the area of the new absorption trench. The percolation rate for this material is between 1 and 5 minutes per inch. No groundwater was found dUring placement of the test hole and none was noted during the monitoring period. We are therefore proposing to place a new 1,500-gallon septic tank and a 63' long by 5' wide by 4' effective depth absorption trench to treat the effluent generated in the house. The elevation of the distribution line in the absorption trench will be 4' below the surface and the total depth will be 8'. Sufficient fill will be placed over the trench and septic tank to prevent frost penetration and possible freezing. The ground surface on the lot slopes at shallow grades from east to west and north to Wl/2, SWl/4, NEll4, Section 9, T12N, R4W January '12, 2004 Page Two south. The trench will be constructed parallel with the slope as much as possible in conformance with Municipal requirements. The new septic system will be constructed a minimum of 100' from the existing well and any surface water in the area. If the system is constructed in accordance with our design the following statements apply: ]. The system, if constructed as designed, will hav(~ no adverse impact on the wells in the area or those to be constructed in the future. The' new subdivision will be served by a community water system.
