Conversations with local well drillers and the failure of corrective disinfection techniques indicates some water aquifers are contaminated. Use of the contaminated wells for washing, bathing, or drinking purposes should be prohibited regardless of disinfection. Drinking and bathing water should be hauled in. The possibility of an alternate water supply (community system) should be explored by affected homeowners. In the interim, health inspections requested by lending institutions can not be approved on the affected wells. We spent some time at the home of Mr. Donald Ballard who lives on Juanita Loop Road and who, over the past four years, has had a number of serious well contamination problems. I've enclosed an October 31, 1979 letter to Mr. and Mrs. Ballard from the Anchorage Office of the Ombudsman, which addressed the same problems. . The high population density and poor soil and drainage conditions in some areas of Eagle River are unsuitable for proper septic tank and drainfield operation and are contributing significantly to private well contamination. This situation is creating a serious health hazard.to some residents in the area. Mr. Ballard is one of the few residents in the area voicing concern, although he says several wells in the area are either dry or polluted, causing residents to haul water into their property or to attempt to disinfect water before using it. The Environmental Health Division and Alaska Department of Environmental Conservation have been involved in investigations of this problem and several wells have been identified as being contaminated from human fecal coli- form levels far in excess of acceptable levels. Discussions with Municipal public health and utilities staff in- dicate that providing sewer service to the area by connection to the Eagle River Wastewater Treatment Plant could improve this. situation. However, the shallow aquifers that can economically provide individual water service could still be subject to pollu- tion from urban runoff, poor well construction and other urban density -related factors. Community water supply, private or pub- lic may be the only economically feasible method for reaching the deeper aquifers beneath bedrock, which will require hundreds of feet of rock drilling and casing plus higher pumping costs. Mr. Ballard feels very strongly that the Municipality should step in and provide water and possibly sewer service to the area. Un- fortunately, there does not seem to be any local support for this point of view, except for a few scattered neighbors with similar problems. Assemblyman O'Connor is well aware of the problem and is actively exploring possible private water supply sources in Mr. Ballard's vicinity. �, r Page 2 P. n Water Supply Cc .amination We discussed the possibility of state and/or federal grants to assist in providing water and sewer to the area. It appears that some form of public ownership of the utilities would be required to obtain such assistance. The Municipality of Anchorage currently has no authority through the Alaska Public Utility Commission (APUC) to provide water or sewer service to Mr. Ballard's area, with or without grant assistance. If a group of citizens were to petition the Municipality for such utility services and petition the APUC also, Municipal water and sewer could be possible. As it now stands however, community water service can only be provided by local authorized purveyors in the area. Long range water resource planning for the area is currently under way and could ultimately open up the development of adequate water supply for the area, but Assemblyman O'Connor stated that this would be several years down the road and would not relieve the immediate problem for Mr. Ballard. In summary there appears to be very little that the Municipality can do at this time for Mr. Ballard and the other residents with inadequate water and/or sewer systems. I suggested that he continue seeking a private water supplier, for which Assemblyman O'Connor has offered his continued assistance. The possibility of a Municipal water system in the area in the near future will require a concerted effort on the part of Eagle River area residents to petition the APUC and the Municipality and such support does not appear to exist at this time. The first sewer interceptor in Eagle River was constructed with the assistance of bond money. It serves the Eagle River business section and adjacent residential areas. Later, developers constructed portions of another interceptor. Da,.,--lopers are reimbursed for construction costs as citizens connect to the line. There is a "bottleneck" because the middle lines are lateral lines which are smaller than either end. The sewage flows from a twelve inch interceptorinto six or eight inch lines and then back, to a 24 inch interceptor before reaching the sewage treatment plant. The recent bond issue is needed to construct the Eagle River Road 24 inch interceptor which is the middle portion. The construction of this section of the interceptor will relieve the "bottleneck". Bond issues must be presented to all voters within the service area, because the bond indebtedness affects everyone. But the actual costs of the Eagle River Road interceptor will be paid for by user rate fees. The Juanita Loop area will not pay the costs for the Eagle River Road interceptor, because the area does not receive direct benefit. The construction of the interceptor has been scheduled for many years. There has been some pressure to speed up the construction project so that the developments may hook into the sewer system. Right-of-way acquisition problems must be corrected before construction can begin this spring, which is the scheduled start-up time. ..N .. October 31, 119,79 Edrie and Donald Ballard Page 2 Another sewer construction by a private developer in Eagle River is currently underway. It is located near the inter- section of Eagle River Loop Road and Eagle River Road. The developer is paying 100% of the cost and receives 1008 of the benefit for the line. There are no bond funds involved with this project. Plans are underway to build the Fire Lake Interceptor which will serve your area. Construction will be in two phases. It is uncertain at this time exactly where the division will be between phase I and phase II. The first phase is scheduled to be started in 1981. With regard to the Fire Lake Interceptor the Eagle River service area may not extend through the Fire. Lake area. An adjustment of the service area boundary may be necessary before construction can commence. Ms. Ballard had additional questions concerning the neighbor- hood attempts to develop a community well system and the lack of Municipal assistance with the project. The Alaska Public Utility Commission (APUC) defines service area boundary for utility services. The Juanita Loop area is outside the current Municipal water service area. APUC approval would be necessary before the Municipal Water Utility could provide water service for that area. In order to receive grant aid for the construction of the project, alocal government entity such as the Municipality .would need to be involved with the project. Unfortunately, with the government's involvement often comes more restrictive prcject requirements. The project requirements often make the costs for the development prohibitive for the limited number of homeowners who may benefit from the service. Because of the small area of service for a Juanita Loop water project, the Municipality believes the benefit of grant receipt would be overshadowed by increased project requirements. The Municipal water utility recently released a water system operated in Girdwood due to the requirements for upgrading the system because of government involvement. The homeowners determined they could manage the water system themselves and not be . required to upgrade the system if the Municipality were not involved and the utility is now a private utility. The Water Utility is examining the long range possibilities of supplying water service to the Eagle River area. If this were to be developed, the cost of construction could be spread over a larger area and it might become cost effective to develop a water system to service your neighborhood. Unfortunately, these long range development plans and implementation are not likely in the near future. October 31, 1979 Edrie and Donald Ballard Page 3 My source for this information was Mr. Brian Crewdson (277-7622), Administrative Assistant to the General Manager of Water and Sewer Utility. Mr. Crewdson mentioned that he would be glad to discuss with you the timetable currently slated for the Fire Lake Interceptor construction and the effects it might have in your neighborhood. They have recently learned of a Federal program which may help provide money to speed up the construction date. I wish that I might have been more successful with solving the difficulties concerning your well and septic system (cases 79-657 and 79-936). Unfortunately, the solution for these problems is not administrative but legal. A private attorney could assist you in evaluating any claims you may have against the Municipality. I hope that my explanations have provided some insight into the decision-making process for sewer and water service in the Eagle River area. You should realize the contamination potential, as your risk, since no one can guarantee subsurface conditions. DRILLING INFORMATION The test hole was drilled with a truck mounted Mobile B-50 drill. The Mobile B-50 drill employs a hollow - stem, continuous flight auger. Field data includes stan- dard Penetration Tests which involved driving a 2 inch split spoon sampler with a 140 pound hammer free -falling a distance of 30 inches. Split spoon samples were taken at five foot intervals. The soils are then vis- ually classified, bagged and delivered to our laboratory for Moisture Content and Classification. SUBSURFACE SOILS INFORMATION The soils found in this test hole consisted of a thin layer of Sandy Gravel and Reddish Silt, Silty Sand (SM) Sandy Silt (ML). The biggest problem has been identifying the source. Mr. Norman's response indicates the probable extent of Municipal liability in this case and the extent of Mr. Ballard's appeal rights. This area is in need of public sewer service. However it is not even in the projection yet and will be many years away. In the meantime, the people in this area will have to take every prevent- ative measure available to keep their septic systems functional. At this point, the Ballards are in a position to pursue either a Superior Court appeal from an adverse administrative decision or other litigation involving a negligence claim or both. On the basis of my experience, the probability the Ballards would prevail on either the administrative appeal or the negligence claim is less than 50 percent. The law does not indicate that required municipal approval and inspection of septic system design and construction prior to backfilling constitutes a guarantee of successful operation of the onsite sewer. The price of having onsite sewer systems rather than public, sanitary sewer systems in an urban environment includes a substantial risk the onsite sewer will fail, as the hillside study indicates they often do in the Anchorage area. Bert Hall, Rolf Strickland, and Les Buchholz should be consulted for particular questions about that. From a legal standpoint, the Ballards will have to present a lot more evidence before any negligence could be attributed to the municipal officials in DHEP. As a condition to their purchase of the premises, the existing problem with the septic system was to be cured. The seller, Stephen W. 2erbe, escrowed a portion of the purchase price in order to insure that the problem would be rectified. The Municipality has responded to the discovery of the source of the pollution of the Ballards' well, and of their neighbors the Swaveleys, by holding a hearing July 25, on the question of whether or not to revoke the septic system permit previously issued for the lot in question. It appears extremely likely that this revocation will be Municipality of Anchorage August 7, 1979 Page Two approved by the officer who conducted the hearing, and that the Ballards will be required to cure the septic system problem. At this time, their alternatives appear to be few. Mr. Les Buckholtz, senior environmental specialist for the Municipality of Anchorage, Department of Health and Environmental Protection, has stated his belief that only a holding tank system would solve the problem. Ms. Golding, on the other hand, has mentioned several other possibili- ties, including a "seepage mound" system. No matter which course of action the Ballards must take to solve this problem, it is certain that it will cost money and, quite possibly, depreciate the value of the property in question, (which is the Ballards' residence). It is entirely likely that the Ballards will seek recompense for their losses sustained because of the defec- tive septic system, from one or more of the following entities: Mr. Robert Poole; Mr. Zerbe; and the 11unicipality of Anchorage. Anticipated causes of action include: .(1) Mr. Poole: breach of implied warranties of habitability and workman -like construction; (2) Mr. Zerbe: breach of his implied warranty of habitability and the contractual agreement whereby he was to cure the septic sytem problem as a condition of sale; misrepresentation of the house's water system in general; (3) Municipality of Anchorage: negligent inspection of the septic system; negligent misrepresentation of the septic sytem's qualities; negligent misrepresentation of the possibilities of curing the existing problems with the septic sytem, and the Ballards' detrimental reliance on the drawings furnished by the Municipality. Because of the possiblity that one or more of the parties may ultimately be held liable for the losses facing the Ballards, I am writing this letter to solicit your input and advice, as to your preference for the manner in which Municipality of Anchorage August 7, 1979 Page Three the septic system problem be rectified. This letter is also a demand that the addressee undertake, at his or its own expense, the resolution of this problem. The situation the Ballards find themselves in is extremely unfortunate and not one of their making. B. Untreated discharges. No person shall cause or permit any sewage or other wastes to be discharged into or disposed of in such a manner that access will be gained to ariy waters of the State of Alaska, unless such sewage or wastes are first treated in a manner approved by the department and the Alaska Department of Environmental Conservation. C. ,Hazardous discharges. No person 51'.311 cause or permit any human excreta, kitchen wastes, laundry ,vater, sink water, toilet wastes, septic tank effluent, sewage or other wastes to be discharged or flow upon the surface of the ground or into any ditch, gutter, street, roadway, stream, lake, underground water source or public place, nor onto any private property so as to create a nuisance or health hazard. D. Watershed areas. No person shall cause or permit a sewage disposal system to be located within the drainage of any watershed area used for or reserved for use as a source of public water supply without the written approval of the department. Such sewage disposal systems shall consist of an adequately sized, self-contained tank, a tried and proven incineration device or other similar methods approved by the department. No method of sewage disposal shall be used in any watershed drainage or any area reserved for use as a watershed to provide a public water supply, when such is of an experimental nature. The department shall promulgate and enforce such regulations necessary to prevent contamination of watershed areas. Such regulations shall include but not be limited to tank construction, tank size, tank location and methods of servicing that will guarantee adequate watershed protection. 15-72 A. Any false statement set forth in the application; B. Any violation of the express terms or provisions of the permit or license; C. The commission of any act not authorized by the permit or license or prohibited by that chapter of this title governing the issuance of the permit or license; p. Permitting unauthorized persons to commit any act not authorized by the permit or license or prohibited by that chapter of this title governing the issuance of the permit or license; E. Repeated acts prohibited by law or by the permit or license for which no prior action was taken by the department. (Adapted from CAC 10.56.080). 15.05.090 Administrative hearings. A. Except as provided by subsections B and D below, no decision to revoke, suspend or otherwise limit or restrict a license or permit granted under this title shall be effective until the person or persons holding such license or permit are first given an opportunity to be heard before that decision is made. Administrative hearings under this section shall be conducted by the director or his designee pursuant to Chapter 3.60 of this code. B. Except as provided by subsection D below, the director may without prior warning, notice or hearing suspend or otherwise restrict any license or permit granted under this title if' such action is necessary to eliminate an immediate and substantial danger to the public health, safety and welfare. All appeals of any final adverse decision of the director made pursuant to this title shall be made to the Superior Court, Third Judicial District, at Anchorage, Alaska no later than 30 days following that decision. "Official" means any person elected, appointed, named or employed by the Municipality of Anchorage to conduct as part of his duties quasi-judicial proceedings or administrative hearings. D. "Quasi-judicial proceeding" means any hearing, formal conference or other proceeding before a municipal board, commission or official, to review the legality, appropriateness or wisdom of official actions taken on behalf of the Municipality of Anchorage as they relate to the particular legal rights, privileges, duties, obligations or remedies of identified individuals. (AO 154-76). 3.60.020 Parties appellant. Where, under the terms of this code, a quasi-judicial proceeding is permitted to review any administrative decision, order, determination, finding or other official action taken on behalf of the municipality, any person aggrieved by the administrative action may appeal to the board, commission or official empowered by law to conduct such quasi-judicial proceeding. (AO 154-76). 3.60.025 Accusation. An administrative hearing permitted under this code to determine whether a right, authority, license, privilege or permit should be suspended, revoked, limited or conditioned shall be initiated by the filing of an accusation on behalf of the official, board or commission empowered to take such action. The accusation shall: A. Set forth in writing, in ordinary and concise language, the acts or omissions with which the respondent is charged so that a defense may be prepared; B. Specify the ordinance, statute or regulation which the respondent is alleged to have violated, but may not consist merely of charges phrased in the language of the statute and rule; and C. Must be served personally on the respondent, or in compliance with the Alaska Rules of Court. (AO 154-76). 3-26 3.60.045 Hearing procedures. Administrative hearings and quasi-judicial proceedings shall be conducted informally and may be governed by such rules and procedures as the official, agency, board or commission empowered to conduct such hearings or proceedings may choose to establish, except that: A. Parties may appear in person or through counsel. S. Parties may present witnesses and evidence on their own behalf. C. Parties or their counsel may cross-examine opposing witnesses on matters relevant to the issues, impeach witnesses regardless of which party first called the witness to testify, and rebut evidence against himself. D. Relevant evidence shall be admitted if it is the sort of evidence on which responsible persons are accustomed to rely in the conduct of serious affairs, regardless of the existence of a common law or statutory rule which makes improper the admission of the evidence over objection in a civil action. Hearsay evidence may be considered provided there are guarantees of its trustworthiness and that it is more probative on the point for which it is offered than any other evidence which the proponent can procure by reasonable efforts. This information is in addition to that which was discussed in my May 22, 1979 letter to you. The results of the fluorescein tracing of May 13 — 20, 1979, show that 72 hours after the dye was put into the Ballard toilet, it reached the Ballard well. By 168 hours, the dye was present in the Swavely well (see enclosed chart). Obviously, this indicates that the Ballard septic system is the source of fecal contamination for these two wells. However, I strongly suspect that terminates at 20 feet below the may, therefore, be substandard. is probably surface runoff. the casing of the Ballard well surface of the ground. I would like to take this opportunity to give you a preliminary report of my findings. I have tested for total coliform bacteria at a number of homes in Juanita Loop. Generally, most results have been negative. For any positive results, fecal coliform tests were performed. As you know, many wells in the area are hand dug and are, there- fore, susceptible to surface contamination, especially during spring run-off. On the other hand, I was looking for sewage - contaminated wells. Although the well is cased, it is a shallow hand dug well. It is my be- lief that it had received surface water contamination. The prob- lem may no longer exist. Lot 9, owned by Mr. and Mrs. Kenneth Bohannon. This is another 18.06LH r. r1 Les Buchholtz 2 May 22, 1979 case of a hand dug well being contaminated by surface water run off during the spring break-up. Lot 9 water supply was contam- inated with fecal coliforms, but these fecal levels were always low (MPN a 2-8/100 ml). Lot 10, owned by Mr. and Mrs. Claude Hunter. The Lot 10 water supply never showed any total or fecal contamination. The ni- trate and chloride levels were also characteristically low. It is interesting to note that this home is also supplied by a dug well which is positioned just next to the driveway. Lot 38, owned by Mr. and Mrs. Donald Ballard, and Lot 6, owned by Mr. Ron Swavely. The Lot 6 well is actually on Lot 7, close to the Ballard/Swavely property line. The Lot 6 and Lot 38 wells are only 35 feet apart. They are also relatively shallow (30-50 feet in depth). These two wells always showed consistent- ly similar contamination patterns. Fecal levels and nitrate levels were always very elevated. The chloride levels were astronomical, from 400-700 mg/1, while characteristic chloride levels were approximately 15-30 mg/1. The source for these extensive chloride levels was discovered to be the Ballard's water softener which releases chloride ions into the septic sys- tem. These ions then travel with the groundwater to the wells. A tracer study using fluorescein dye was performed and confirmed these results. After saturating the Ballard's septic system with the dye --one-half pound pre -mixed was placed in the toilet -- the dye could be seen in the Ballard's water after 3 days. By seven days, the tracer could be seen by eye in the Swavely's water. One source of fecal contamination is now known. Lot 5, owned by Mr. Ron Swavely. The water supply on this lot showed consistently high fecal, nitrate, and chloride levels until the end of April, when all levels dropped dramatically. There are two possibilities for the decreases in sewage indi- cators. First, Mr. Swavely pumped the cesspool twice in April. Two weeks later, fecal coliform numbers had decreased. Second, the Hunter septic system (Lot 10) is very close to the Hunter/ Swavely property line and is within 40 feet of the Swavely well. The decrease in fecal coliforms may be due to a drop in the ground -water level after break-up. I hope to perform a tracer study to determine which septic system is the cause of contam- ination. The contamination problem has many sources. I can say now that it is not a total aquifer contamination. The most serious prob- lem is the Ballard's septic system. Our office will expect you to take appropriate action to alleviate this source of contam- ination. When the problem is resolved, we would like to be made aware of the resolution. DEPARTMENT OF HEALTH AND ENVIRONMENTAL PROTECTION ANCHORAGE, ALASKA In Re: Donald and Edried Ballard 1 Administrative Appeal 79-15-1 DECISION Pursuant to § 15.05.090(C) of the Anchorage Environmental Protection Code providing such administrative appeals and hearings, a hearing was held to consider the termination of a sewer permit issued to Donald J. Ballard for Lot 38 Debora Subdivision. This hearing was held July 25, 1979. The hearing was attended by five people. The meeting began with Les Buchholz of the Municipality of Anchorage, Department of Health and Environmental Protection, giving a brief overview of the problems. This was followed by questions by Mr. Richard L. Crabtree, attorney for Donald J. Ballard, which was then followed by testimony by Linda Mattes Golding, State of Alaska, Department of Environmental Conservation, which was again followed by questions by Mr. Crabtree. This was followed by comments and questions by all concerned. All parties or their counsel were given the opportunity to cross examine opposing testimony and to rebut evidence. FINDINGS OF FACT 1. Approximately two and one-half years ago at the request of a lending institution, the Department of Health and Environmental Protection evaluated Lot 38's sewer system. Their finding was that the cesspool system then in place was not adequately functional nor did it meet Municipal Code. Department of Health and Environmental Protection recommended that the system be upgraded and these recommendations were followed. was approved by the Municipality. Subsequent to this the system 2. Because contaminants were found in area wells, a study was conducted by Linda Golding at the request of the Department of Health and Environmental Protection. In the course of this study Ms. Golding had the full cooperation of the Ballards. 3. I find that, as the study showed, the Ballard's septic system is contaminating two underground water sources, namely the Ballard's well and a nearby neighbor's well. CONCLUSIONS OF LAW 1. The Environmental Protection Code at § 15.65.020(A) states that: No person shall dispose of any human excreta, sewage and other wastes except in a properly designed, constructed and maintained sanitary sewerage system, septic tank or by other methods approved by the Department of Health and Environmental Protection, . . . . 2. The Environmental Protection Code at § 15.65.020(C) states that: No person shall cause or permit any human excreta, kitchen waste, laundary water, sink water, toilet waste, septic tank effluent, sewage or other waste to be discharged or flow upon the surface of the ground or to any ditch, gutter, street, roadway, stream, lake, underground water source or public place, nor into any private property so as to create a nuisance or health hazard. -2- r-- 3. The contamination of nearby underground water sources by the Ballard sewer system effluent constitutes (a) a disposal method not approved by the department and therefore in violation of § 15.65.020(A) and (b) a nuisance and health hazard in violation of § 15.65.020(C). Therefore, it is my decision that the permission previously granted by this department to operate the sewer system on the Ballard's property is hereby revoked. Should additional evidence come to light, the Ballards may reapply for a permit, and if denied, they may ask for an Administrative Hearing to review that decision. Due to the number of lots the proposed system would serve, we would classify it as a Class A system. Consequently, septic tanks and drainfields would have to be located at least 200 feet from the well. This will rule out any development on several lots possibly 12 or more) unless a community sewerage system is also constructed. In addition, Mr. Swavely's existing well does not come close to meeting department requirements and we could not approve it as a public water system unless steps are taken to remove existing sources of contamination from the protective area. This decision is reinforced by the fact that the well is shal- low (40 feet) and nearby wells have become contaminated. There are a couple of points we feel should be considered in this situation: 1. What has caused the individual wells to become contaminated and what can be done to correct the problem? This is our biggest concern when considering use of the existing well. 2. Based on the information we have available, we would strongly recommend community sewerage service. If this was provided, it would eliminate our concern regarding construction of a public water system. In closing, I would like to point out that it will be necessary for Mr. Swavely to have plans of his proposed water system pre- pared and signed by an engineer registered in the State of Alaska. Buchholz Sanitarian FROM: principal Environmental Control Officer SUBJECT: Summary Thursday, January 20, 1977: Arrived at Lot 35 Block E Debora Subdivision in early afternoon and found no one home. Friday, January 21, 1977: Arrived at Lot 35 Block E Debora Subdivision at 1:40 p.m. and talked with Mrs. Benson, she stated the following: M S W Drilling Company drilled their water well on the 10th or 11th of December, 1975. That the sewer system was already on the property when they bought it so they thought that it was already approved prior to their hook up, which took place sometime in June of 1975. She stated that the structure was built just prior to sewer hook up sometime in June of 1975. I then took a water sample, and dyed the sewer system via the cleanout pipe just next to their cabin on the north side. 4:05 p.m.: Talked with Les Buchholz about Debora Subdivision problem and headvised me to call Benson's for the well log. I called the Benson residence and talked with Mr. Benson, He stated that he had a well log and would be glad to give it to US. Monday, January 24, 1977: 12:19 p.m., Arrived at Debora Subdivision Lot 35 Block E to pick up the well log. I talked with Mrs. Benson again and she stated to me the following: There was a trailer on the property hooked up to an old sewer system and they moved it off to build their cabin and hooked into the existing sewer system because they felt that it was previously approved, thus wouldn't need any further approval. She looked through the files and found the well log, but no well permit. I asked her if they had taken out a well permit and she said that when they had the well drilled that the driller said that he would take care of everything. 91 01914/761 Lcs Buchholi January 26, 1977 Page Two I then looked the property over for dye and found none. Then proceeded back to the office. Wednesday, January 26, 1977: At 11:19 a.m., I received a call from Laura on the radio that Debora Subdivision Lot 35 Bloc: E water test results had come back positive (9.2). I had to meet with Glenn Briggs in Eagle River and was on my way out so I decided to stop at the Benson's residence. 12:00 p.m., I stopped in at the Benson residence and took another water sample. I warned her that the well should be chlorinated, explained how and told Mrs. Benson to boil their drinking water until the problem was resolved. William M. This amount of dissipation is not sufficient for the department to approve the septic system for a three (3) bedroom home. Serbe have stated that the seepage pit has been pumped in the past when they noticed that the level had risen in the standpipe, but that the system had.never overflowed. I found no evidence of overflow around the standpipe, and I believe tho present pit is just barely holding its own. It is possible that clue to the difficult frost conditions this past winter, that the pit's seepage will iwpeeva after the ground thaws crate but this could not be detereined until approximately July 1, 1976.
