Subject: tLot 92A USS #3042, Illegal Well and Septic System
In response to a complaint concerning dwelling units without sewer and water, a
field investigation was conducted and revealed the presence of an existing earth
privy 38 feet from an existing well on the subject property.
In checking our files, it was discovered that we do not have any recorded per—
mits for either the well or the earth privy. According to Municipal Code
15.65.100 (A) (5), no privy shall be used where "adequate water supply is
available to operate a water—carried sewage disposal system...". Further,
Municipal Code 15.55.040 prohibits water well construction without first
obtaining a permit from this Department.
The following action must be taken to correct the above noted violations:
1. Properly abandon the earth privy and install a holding tank 100 feet from
the existing well. (Note: A permit to install a holding tank must be
't, obtained from this Department), or
/ll%� G 2. Properly abandon the well in accordance to Municipal Code 15.55.060 (K) (2b),
and obtain a permit from this Department for the existing earth privy.
Please be advised that the action herein referred to must be completed no later
than June 1, 1985.

Permits are issued on a calendar year basis by authority of Municipal
Ordinance. A new permit must be obtained from this Department for any

If you have drilled the well, a well log needs to be sent to this
Department for documentation of the installation and to close the permit.
If a private engineer inspected the installation of the on-site sewer system
the original as -built inspection report(three part form) must be sent to

MEMORANDUM

SUBJECT: Lot 92A, USS 3042
According to your report, the subject property has a privy situated 38 feet from
the private well serving that property, and there is no evidence that a permit
was issued by this department for either the well or privy. According to
Section 15.65.100(A)(5) of the Municipal Code, no privy shall be used where
"adequate water supply is available to operate a water carried sewage disposal
system...". There are also violations from the standpoint that no permits were
issued from this department.
You should first attempt voluntary compliance as follows:
1. Require that the privy be properly abandoned and a holding tank be
installed according to today's standards, with a high-water alarm and
pumping -maintenance contract in effect. A permit must first be
obtained. The well can remain but basic construction must be verified
by an engineer with assistance from a driller, and a permit must be
obtained. All separation distances must be met; or
2. The well should be properly abandoned according to AWWA standards, and
a permit for the privy obtained. Prior to issuing a permit for the
privy, soil and ground water characteristics must be evaluated, as
usual.
If voluntary compliance is not achieved in a timely fashion, enforcement action
must be taken.
Please keep current with this case and discuss any problems with me.

The Municipality of Anchorage Development Services Department (DSD) Issues Certificates of On -Site Systems
Approval (COSA) based only upon the representations given in paragraph 4 by an Independent professional civil
engineer registered in the State of Alaska. Certificates of On -Site Systems Approval are required for the transfer of
title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or water - - -
supply system. DSD also issues COSAs upon request to homeowners. Certificates of Onsite Systems Approval
are valid for 90 days from the date of issue for properties served by a private or Class C well and may be reissued
with new water sample results. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.

The holding tank was approved and installed in 1983. The holding
tank was pumped on March 7, 2006. The holding tank permit was
approved for a 75' separation from the on -lot well. The holding tank,
however, was installed at 71'.

The holding tank has encroached the well on -lot for more than 20
years. The water well was tested and showed none detected
nitrates, and 0 coliform, and 0 coliform. Arsenics is under the limit at
9.48 ug/I, however it is elevated. Arsenics is a naturally occuring
mineral in the well that would not come from any encroachment from
a septic holding tank. If the holding tank were to over flow the well is
located upgradiant and effluent wouldn't travel toward the well.

LOT 92A US SURVEY 3042
We are applying for a waiver of the separation distances required between the holding tank and
the well serving this lot.
A new 2000 gal steel holding tank was installed in 1983. The separation distance between the
holding tank and the well on lot 92A was recorded as 75 feet on the Onsite Sewage Disposal
System and/or Well inspection report. During the COSA application process, the measured
distance between the nearest outside edge of the well casing and the holding tank stand pipe was
determined to be approximately 74 feet. The well is located up gradient from the holding tank.
The holding tank was pumped in October, 2005. The house was vacant over the winter and
during the septic inspection conducted on March 3rd, 2006 the tank had a liquid level of 9.5
inches. The tank was filled and the water level was monitored over several days and remained
constant. The tank was pumped on March 7th, 2006 and the liquid level of 8 inches was recorded.
This was also monitored over several days and remained constant, indicating that the tank is
sound. The high water alarm was tested, and found to be functioning properly.
Neither soil nor a well log is available for lot 92A. Two soil logs for Lot 92C US Survey 3042
where located. Soil log #1 shows silt with sand to a depth of 19 feet, with a percolation rate of
20 minutes per inch. Soil log #2 shows sandy, silty gravel to a depth of 11 feet and sandy gravel
with some silt to a depth of 14 feet. The recorded percolation rate for Soil log #2 was 40 minutes
per inch.
The well log for the well serving Lot 92C US Survey 3042 indicates the following soil layers:
clay and gravel, silty gravel, and clay and gravel to a depth of 190 feet. The static water level

was recorded at 27 feet below the ground surface. The well log for lot 91 A US Survey 3042
indicates the following soil layers: silty, sand and gravel, sand and gravel, clay and gravel, silty
sand, and silty gravel to a depth of 224 feet. The static water level was recorded at 47 feet below
the ground surface.
Nitrate, total coli form and other bacteria were not detected in the water sample collected from
the well on the subject lot on March 5'h, 2006.
Mitigating Factors:
The lot is sloping down from the existing well to the holding tank. If the holding tank were to
overflow, the effluent would flow away from the well head.
The holding tank is sound and is not leaking. A high water alarm provides the residents' ample
time to get the tank pumped before overflow can occur.
Well logs from the surrounding wells indicate that the aquifer is confined by layers of
impermeable soils, preventing subsurface contamination.
The holding tank has been in place for 23 years and water samples do not indicate any
contamination.
Waiver Request: 71 feet from holding tank to well.

US Survey 3042, an Survey As -built of Lot 92A US Survey 3042, showing the location of the
well and the holding tank, and water sample results for coli form and nitrates.
