This response is part of request for a 2nd time extension for Denaly subdivision. The request is for a 60 -month time extension to construct both phases. As part of the application a variance has been requested for lots not adjacent to a public right-of-way. Also requested is a variance for a cul-de-sac length longer than the 900 feet allowed in a rural district. This is a phased development that will eventually provide through access and eliminate the cul-de-sac altogether. The topography is now shown on the preliminary plat drawings. 3. The stream maintenance and protection easement is now shown on the plat. 4. Eagle River and the general flood zone is shown on the preliminary plat drawing as the subdivision is not located within the flood zone the flood zone contour is not shown on the plat. 5. The wetlands boundary shown on the original preliminary plat was not based on field survey data. Verification of the wetland boundaries may be requested by the Municipal Wetlands coordinator. 6. The lot configuration of Phase 2 has increased the density of the development. While the DUA of Phase 2 is over the .75 DUA required by AO 99-12, when the overall DUA Is computed for the Phases 2 and 3 the DUA is .55 and well below the DUA requirement. 7. No greenbelts are required by code and the new preliminary plat will not dedicated any greenbelts for common use. 8. The creek originally shown on lots 39 and 40 was been rerouted and not longer impacts the subject lots. As with the wetlands boundaries, verification creek may be requested by the Municipal Wetlands coordinator. 9. The new plat note No. 3 only identifies that the easement exists. With the development of Phase 3 new right-of-way will be dedicated to provide legal access. 10. The new preliminary drawing contains detail and dimension detail for Phase 3. 11. We are assuming that on approval of the original preliminary plat that Tract 5 was proposed as greenbelt area and therefore was conditioned to be dedicated to the homeowners as part of the plat approval. However, as there is no code requirement for greenbelts in this district the use as residential lots is allowed. The topography in the area is steep and some grading will be required to construct the driveways to municipal standards. The petitioner will work with MOA traffic and PM&E to resolve the driveway issue prior to recording the final plat. If it is determined that the steep terrain will not allow for 3 lots, a lot may be eliminated to allow for an adequate driveway. 12. The alignments of Tikhatna Circle and Tikhatna Drive have changed and new design drawings have been submitted to MOA Traffic and PM&E. This entire issue will be resolved as a condition of the final plat. 13. EXPLAIN: The area in question Is a notch In a larger portion of land limiting ROW design to serve the lots. The entire area is located In steep terrain which further limits ROW design. The lots are bound to the north by an Irregular shaped boundary which does not allow frontage on the public ROW. EXPLAIN: In no way will the granting of this variance have an impact on public welfare, property, or safety. The lots will still have physical and legal access through a public use easement created with this plat. EXPLAIN: The effect of granting the variance will not have a nullifying Intent because the lots will still have physical and legal access through a public use easement created with this plat. Additionally, the public use easement will only serve two single family lots so dedicated public ROW Is not required to handle this very small amount of traffic. The public use easement is essentially a driveway. Undue hardship would result from strict compliance with specific provisions or requirements of the subdivision regulations. EXPLAIN: Undue hardship would result If the variance is not granted, In that the subdivision has no other design options. Limiting design features such as the irregularly shaped north boundary of the parcel and the steep terrain make the proposed design the best solution for this area. The land would essentially be unusable without this variance. Subject: Denaly Subdivision - Case S-10388-3 Dan, With regard to Denaly Subdivision and the request for a second 18 month time extension, I am sure you have noticed that this new plat is quite different from the plat that was originally approved back in 1999. As it is a second time extension we need to come up with a whole new list of conditions of approval. While it is fine to recommend the same thing as was recommended in 1999, there are a few issues that may be of particular interest to you which you might want to address. 1) What was originally Tract 2 (within Phase 3 of the original preliminary plat) has been replaced with lots 39 and 40 on the new plat. These lots were highly impacted by the creek setback which was shown on the plat as originally approved (and interestingly enough is no longer shown). It is my understanding that Steve Ellis with Watershed Management thinks the creek still is there. Therefore he will likely require that they delineate the creek setback on the plat. This leaves the issue of whether or not these lots can accommodate a well and septic system. Would you like a condition placed on the plat that requires them to prove that these lots can accommodate a well and septic? If so if you could provide a condition for inclusion that would be great. Or possibly the standard conditions cover this? 2) On the original preliminary plat as approved, there was a well located on Lots 47 and 48. This well is no longer shown. I don't know if it is there or not, however if you would like a condition or to show the location of the well or provide evidence that it has been decommissioned if you could provide a condition to that effect it would be appreciated. The original Summary of Action with the conditions of approval has been attached for your review.
