To whom it may concern: During recent excavation work (by Wilco Contractors) to rebuild the existing lined IDSF system, it was discovered that the IDSF was surcharged because there was no outlet pipe, after the sampling port, providing continuity to the drainfield. It was also discovered that the inlet to the drainfield was simply capped off, and that effluent could not reach the drainfield. In short, it did not appear that the drainfield was ever connected to the IDSF. It should be noted that as soon as the outlet side of the sampling port was exposed, the IDSF drained itself completely within a matter of minutes. The IDSF itself was inspected in numerous places, and found to be free of any bio -matt material. In short, the IDSF did not require rebuilding, and was not rebuilt. After discussions with your department, Wilco Contractors proceeded to install a gravity feed 4" D3034 sewer line from a new sampling port, down to the drainfield. Double cleanouts were installed between the sampling port and the drainfield, and a new monitoring tube was installed (set to the correct elevation) in the IDSF. The flushing valves in the IDSF were found, repaired and extended above grade. Also, both cleanouts on the tank were replaced with code compliant 4" D3034. Please find the attached sketch of the new 4" sampling port, as approved during discussions with your department. Dear Mr. Spurkland: This letter is in response to the information received in this office March 3, 1998, requesting operation approval of the recently constructed on-site water and wastewater disposal systems serving a proposed bed and breakfast operation. The Department has completed its review of the submitted information which included an as -built of the completed water system, wastewater disposal system, site plan, and water sample analysis for total coliform bacteria and nitrate. Based upon this review the Department has the following comments regarding operation approval of the recently constructed water and wastewater disposal systems: Public Water System: From the submitted information concerning the water system including the reported well flow test results it appears that the water system was constructed substantially in accordance with State Drinking Water Regulations (18 AAC 80.300). Results from the submitted water sample analysis for both total coliform bacteria and nitrate were satisfactory, and meets the requirements as a sanitary source of water. Assuming that the change in status from a single family residence to a proposed Bed and Breakfast does not significantly change the demand for water use within the residence, this water system meets the concerns of this Department. Therefore, in accordance with 18 AAC 80.300 approval to operate is granted by this Department subject to the following comments and conditions: This water system has been assigned the following public water system identification number (PWSID no.) 218552. Class "C" water systems are not required to routinely sample the water. However, to assure the owner/operator that the water provided to both the guests and residents from this water system meets sanitary requirements, this Department recommends routine annual sampling for both total coliform bacteria and nitrate. Attached is a copy of the completed Construction and Operation Certificate for Public Water Systems with the Approval to Operate section completed verifying this Department's approval to operate the water system. Wastewater Disposal System: From the submitted information it appears that the on-site wastewater disposal system which includes a deep trench receiving treated effluent from an intermittent sand filter was constructed substantially in accordance with the plans previously reviewed and approved by this Department. Therefore, in accordance with State Wastewater Disposal Regulations (18 AAC 72.200) approval to operate is granted. Attached is a Construction and Operation Certificate for Domestic Wastewater Disposal Systems with the Approval to Operate section completed verifying this Department's approval. Dear Mr. Spurkland: This letter is in response to the information received in this office November 14 and 17, 1997, requesting construction and operation approval for a proposed Class "C" public water and on-site wastewater disposal system. From the information submitted and previous discussions regarding this project it appears that due to the soil conditions and physical constraints of this site there are limited areas in which to place an on-site wastewater disposal system. The Department has completed its review of the submitted information which included a cover letter, site plan, engineered design drawings, well logs, soils logs, hydrogeologic studies and wastewater treatment design calculations. Based upon this review the Department has the following comments: Horizontal Separation Distance Waiver: A review of the submitted information indicates that the proposed absorption trench for the on-site wastewater disposal site is constructed within the required 100 -foot setback requirement from a surface water body. After careful review of the submitted information including soils logs, and surrounding well logs, it appears that the separation distance of 90 feet as reported, should present minimal threat of contamination of the surface water body (South Fork Little Campbell Creek) flowing through this property. A site inspection conducted December 1, 1997, found a separation distance of 92.5 feet from the creek to the middle of the absorption trench cleanout. Therefore, in accordance with State Wastewater Disposal Regulations (18 AAC 72.015) approval of a lesser horizontal separation distance of 90 feet between a wastewater disposal system and a surface water body is approved. Public Water System: When a single family residence is used for the purpose of a Bed and Breakfast, the on- site private water system is reclassified to a class "C" public water system. The submitted site plan indicates that a separation distance of 110 feet is requested between the septic tank and the on-site well, which is less than the required 150 feet for a class "C" source well. A site visit found that the sand filter which is under construction is approximately 124.5 feet from the well casing. After careful review of the submitted information it appears that for the intended usage of this well the lesser separation distance of 110 feet requested to a septic tank will present minimal threat of contamination assuming that demand on the well for a Bed and Breakfast does not significantly differ from a single family residence. Operation approval of this water system will require submittal of a well flow test, design calculations verifying system will meet both peak and daily demand requirements, and satisfactory analysis for total coliform bacteria and nitrate. Attached is a copy of the completed Construction and Operation Certificate for Public Water Systems with the Approval to Construct section completed verifying this Department's approval to complete construction of the water system. Wastewater Disposal System: For the intended usage of this residential dwelling (four bedroom single family residence) and the in -site soil conditions as detailed in the submittal, it appears that the soil absorption trench (150 square feet) is adequately sized based upon the intermittent sand filter system proposed for this site. Therefore, in accordance with State Wastewater Disposal Regulations (18 AAC 72.200) approval to construct is granted subject to the following conditions: 1. All installation activities will need to be monitored under the supervision of a Professional Engineer (P.E.). 2. The monitoring tube for the soil absorption trench should be placed at the end of the trench. Operation approval will require that s -built drawings under the stamp of a P.E. be submitted to this office within 90 days of completion of this project verifying soil conditions, water table, and impermeable strata separation. Attached is a Construction and Operation Certificate for Domestic Wastewater Disposal Systems with the Approval to Construct section completed verifying this Department's approval. While routine sampling of Class "C" public water systems are not normally required, this Department recommends that annual sampling for total coliform bacteria and nitrate be conducted to assure users of this facility that this well is producing a sanitary source of water. Please reference the assigned public water system identification number (PWSID no.) 218552, when submitting future water samples so that this system maybe properly credited. The well and drainfield were installed in 1995, however the intended Orenco Intermittent Sandfilter was not. In order to develop this lot the owner had to place a substantial structural fill to create a building site. Retaining walls were supposed to prevent this fill to encroach onto the absorption field area. The owner neglected to build the called for retaining walls with the result that the installed drainfield is covered with approximately 12 feet of fill. The cleanouts and monitor tubes extend through the fill. Likewise is the required replacement site covered by a substantial fill. The permit has expired, and because of the extent of the fill, a redesign of the ISF is required. Health & Human Services July 3, 1995 In response to your letter of May 8, 1995, I checked the water levels in the two testholes on May 27, 1995. TH #I had 33 inches of water which puts the water level at 11 feet below ground surface. Testhole #2 was dry to 8 feet below ground surface. A standard septic system is not appropriate for this lot. In order to develop the lot the owner intend to place approximately 5000 yd of fill . Several retaining walls are planned in order to keep the slopes at a reasonable level. The resulting slopes will be from 1:2 to 1:3 which is too steep for a trench or a bed. A retaining wall will be built to specifically maintain a level slope at the suggested drainfield location. A revised siteplan, showing the proposed final grades are included for your benefit. The Building Department will not review the construction plans without a well and septic permit. A permit was issued in 1990 but the lot was not developed. This is a problem site and conventional septic systems ( trench, bed, or mound) would not perform well. The problems with the site are: The east 1/3 of the lot is wet with standing surface water in several locations. 2. Corwin observed high groundwater levels ( 4.7 ft) in the center portion of the lot in March of 1989. 3. The creek along the north lot line eliminates the north portion of the lot for septic systems. 4. The natural groundslope exceeds 25% in some places in the southeast section of the lot. 5. The basement elevation of the proposed residence will be at 1120. This will require an access road to the septic tank for maintenance. The tank can not be pumped from the drive and parking which is at elevation 1130. Based on the topographical information available, the lot is too steep for a bed or a mound. The presence of groundwater precludes the installation of conventional trenches, unless the upper portion of the sidehill is utilized. This will conflict with the building site, and will most likely conflict with AMC 15.65.060.A.2a. A short trench, and a replacement trench, can be installed uphill from testhole #1. This location does not conflict with AMC 15.65.060.A.2.a, and will be above the high groundwater elevation. We request that an Orenco intermittent sandfilter be installed on this lot. The monitoring of the systems presently installed in Anchorage shows that the systems are working satisfactory when installed with air supply and small dosage discharge. This system should perform well on this lot, and will in the long run protect both the groundwater and the surface waters. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Lay. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The following tasks were to be accomplished prior to issuance of a non -conditional COSA: 1. Bury the well wires 2. Expose the ISF flushing valves and flush all of the pressure lines 3. Get the as -built survey updated to show the flushing valves. In the spring of 2016 the new property owners noted sewage surfacing out the ground between the STEP tank and the IDSF. After some investigation it was discovered that the pressure line between the STEP tank and the IDSF was broken. The line was repaired and the problem rectified. In addition it was discovered that the air line for the ISF was stubbed into the ground and not connected to the ISF and that all but one of the pressure distribution lines in the ISF were damaged. The owners retained A+ Home Services to reconnect the air line and replace all of the pressure lines in the Lined ISF. A+ Home Services also installed new monitoring tubes in the lined IDSF. All of the repairs were done without engineer oversight or inspections; however, the work was done by one of the most experienced contractors in Alaska with IDSFs (A+ Home Services). The well wires have been buried. The asbuilt survey was not updated to show the flushing valves; however, attached is a photo showing the flushing valves. Given that the flushing valves are present, I am requesting that you waive the requirement for an updated asbuilt survey. Permit. An On -Site Wastewater Disposal Permit as required by AMC 15.65 to construct and operate an AWWTS. 3. Term. The term of this Maintenance and Repair Agreement shall begin on the date of approval by the Municipality to operate the installed system or issuance of a COSA, and shall continue while the AW WTS is in use or is operational or until the property is sold or title is transferred by the owner and a new COSA is issued to the new owner or transferee of the property. 4. Alterations. Installation and Removal of Additional Equipment. Throughout the term of this Maintenance and Repair Agreement, the Owner shall maintain their AW WTS in a satisfactory condition capable of producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. The owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the municipality and the manufacturer of the AW WTS for the entire term of the AW WTS In addition, it shall be the responsibility of the Owner during the term of this Maintenance and Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules and orders for the AWWTS. C. Upon request by the Municipality, the owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system. When a record of maintenance is documented and maintained by the system vendor, the owner agrees to allow the Municipality access to this information. D. Owner acknowledges that the fine for failing to maintain and repair an AW WTS may be assessed in accordance with AMC 14.60 for improper discharge. E. Owner agrees that only maintenance and repair personnel approved by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. F. Owner agrees to grant the Municipality reasonable access to test and inspect the AWAITS upon 24 hours written notice. G. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. C H. Owner agrees that the AW WTS installation and maintenance requirements as provided by the AW WTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AW WTS. I. Owner agrees to provide and maintain a telephone connection to the AW WTS as required by the AW WTS approval. 6. Nonwaiver. The failure of either party at any time to enforce a provision of this Maintenance and Repair Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Maintenance and Repair Agreement or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 7. Amendment. A. This Maintenance and Repair Agreement shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality that this Maintenance and Repair Agreement was executed with, and such writing shall be attached to this Maintenance and Repair Agreement as an amendment. B. For the purposes of any amendment modification or change to the terms and conditions of this agreement, the only authorized representatives of the parties are: VIP— '� a. Owner: 1 I G.. VIP �J b. Any attempt to amend, modify, or change this contract by either an unauthorized representative or unauthorized means shall be void. 8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance and Repair Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Maintenance and Repair Agreement. 9. Severability. Any provisions of this Maintenance and Repair Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Maintenance and Repair Agreement.
