The well is approximately 85 feet from the seepage pit that was installed in October of 1971. On March 27th, 1985 ADEC issued a waiver for a separation distance of 94 feet between the well and the seepage pit. Based upon the current as -built survey and the MOA inspection report, it appears the closest edge of the seepage pit is only 85 feet from the well; therefore, we request that your department issue an 85 foot waiver from the well on the subject property to the existing seepage pit. Additionally, the existing septic tank pipe is located approximately 7 feet from the building foundation. The exact dimensions of the septic tank are unknown and it is unknown if a septic tank to foundation encroachment exists. It should also be noted that the well serves the shop and the home. Per conversation with John Beier (owner) the existing shop has a hose bibb and the water line connects to the northeast corner of the shop (see attached sketch). Justifications for the well to seepage pit variance are as follows: -The encroachment has existed for approximately 44 years (since 1971). -Water samples were pulled on 10/28/2015 & 11/30/2015, the results are as follows: -Arsenic: 16.8 -Nitrate: Non-Detectable -E.Coli: Negative -Total Coliform: Negative (following well chlorination) -The existing home is located between the seepage pit and well head. If effluent were to overflow, it would not travel directly towards the well head. -We are only requesting a 15% variance (from 100' to 85'). As can be seen, there is minimal risk in granting this waiver. We are unaware of any adverse impacts associated with this waiver. Please call or email if you have any questions. II. SEPERATION DISTANCE FINDINGS • East and Northeast Lots: Per conversation with David at the AWWU field office on 12/7/2015 & 12/14/2015 the lot directly to the east, 8620 Lake Otis (The Little Red School House) is served by 3701 East Tudor Road, Suite 101 * Anchorage, Alaska 99507-1259 Phone: (907) 337-6179 * Fax: (907) 338.3246 * Website: www.gamessengineedng.com Page 2 oft AWWU for water and sewer and the lot to the northeast (John Wells 1952 Addition; Block 3, Lot 7) is stubbed but not connected to AW WU sewer. Per Anchorage Live and GEG inspection, John Wells 1952 Addition; Block 3, Lot 7 is vacant. • North Lot: Per conversation with Kurt Sandstrom, the owner of the lot to the North, 8500 Arlon Street (John Wells #1 Tract B), Sandstrom & Sons Inc, the well on the lot is located in the southwest portion of the property, about 10-15' from the southwest structure. The septic is located approximately 20-50' to the west of the shop. See attached aerial photo. • West and Southwest Lots: The lot directly to the west (John Wells 1952 Addition; Block 5, Lot 2) and the lot to the southwest (John Wells 1952 Addition; Block 5, Lot 19) are owned by our client. Per conversation with the homeowner and agent (Robert L. Winn), the lot to the west is not served by any well and/or septic system, and the lot to the southwest is served by a private well and holding tank, as shown in MOA records (see attached letter by the homeowner). South Property: The property to the south (John Wells 1952 Addition; Block 5, Lot 20) was originally served by a private well in 1973, as shown in MOA records. It is now a class "C" well serving Reliance Automotive. There are no records as to when it became a class "C" well. Our client's septic system was in place prior to the well becoming a class "C" well. Therefore, it is the responsibility of Reliance Automotive to obtain ADEC waivers to our client's septic system, if ADEC will even issue such waivers (see attached ADEC memorandum). Per phone conversation with the owner (Bill) of Reliance Automotive on 12/15/2015, no septic system upgrade has taken place since the MOA documented system was installed in 1973. IIl. TANK PUMPING The tank pumping receipt states that the first and second compartment of the septic tank were pumped. However, per GEG inspection there are only two septic pipes located on the property. One serves the septic tank and the other serves the seepage pit. Additionally, per the 1971 inspection report, there is only 1 compartment to the septic tank. It is believed that the pumper pumped the seepage pit and the septic tank. IV. The following information is intended to assist in determining whether the current situation is a threat to the public health if allowed to remain. 1. The Class C well appears to have been permitted and constructed in 1973 as an "individual" well. On - site's records do not indicate when it became designated as a Class C well. 2. On -site's records indicate there was debate prior to issuing the well permit whether it would be allowed to be permitted under the then "old" code or "new" incoming code. Apparently it was allowed to be constructed in accordance with the "old" code which would allow it to be within fifty (50) feet its own septic tank. 3. The well's separation distance to the septic system on the subject lot appears to have existed since 1973. 4. The well was constructed in 1973 after the permitted and documented private septic system on the subject lot was approved for operation in 1971. 5. Today as a Class C well, it is under the jurisdiction of the State of Alaska Department of Environmental Conservation (DEC). 6. DEC issued a letter to the public and industry, Policy Revision for Regulating Class C Water Systems, dated September 23, 2015, stating that "Due to limited budget resources, the DW Program cannot fulfill your request at this time. DEC approval for Class C systems is no longer necessary." 7. The private well on the subject property is located near the neighboring Class C well with less separation to the subject property's septic system. Test results show the subject property's well has no coliform bacteria and the Nitrates are "Non Detect". 8. The subject property's well draws from a confined aquifer. Given its the close proximity, it's likely that the Class C well is using the same confined aquifer and should be safe from contamination from nearby septic systems. Given the points mentioned above, it appears plausible that DEC would grant a separation distance waiver for this situation if it was still in the business to grant them. At this time the facts indicate the well is not in danger of becoming polluted due to the stated separation distance and does not appear to be a danger to the public health. On-site will not require a separation distance waiver from DEC as a requirement for approval of the requested COSA (OSC151673) for the subject property. This decision is not to be seen as precedent setting for any other projects or situations, and pertains to the current well and septic systems as constructed on the properties discussed in this letter only. Class C Water Systems are state regulated public water systems that fall outside of the federal definition of a public water symna M). The Public Water System Supervision TWA grant and the Drinking Water State Revolving Fund (DWSRF) set awides we receive from the Environmental Protection Agency are intended to provide oversight for Comm unity Water Systems, Non -Transient Non - Community Water Systems, and Transient Non -Community Water Symms only. In rhe previous Memorandum, the diciective was to immediately cease all activities related to Class C Water Systems, except for those Class C water systems (Residential Care and Assisted living Facilities) specificatiycovered under the WUand RSA with the Department of Health and Human Services, Health Care Services, Residermal Licensing group The MOU and RSA expired on July 1, 2015, and as such, there is no longer an exception for these systems. The DW Prograes budget does not have the necessary funding w cover the work required for the many different types of Class C Water Systems and there is no ffinancial mechanism in place to provide the resources necessary to achieve an acceptable level of service w any Claw C Water System ovrers and operators. DWPwgram resources need to focus on oversight of the federally regrdawd water systems and our Primacy require mew. This inspection revealed an arsenic concentration of 16.8 micrograms per liter (ug/L) for the property's well water sample. The Environmental Protection Agency (EPA) has established a maximum contaminant level (MCL) of 10.0 ug/L for public drinking water systems. While private wells are not subject to this regulation, EPA standards are based on existing health information and can therefore be used to gauge the relative quality of water from private wells. Information on arsenic is available from the On -Site Water and Wastewater Program website (www.muni.or onsite) or at 343-7904.
