An onsite wastewater disposal system permit was issued on August 29, 2014 (Permit number OSP141309). The permit was issued for 4 bedrooms and the septic system has been recently installed based upon this sizing. Two (2) exploratory wells were drilled on the property prior to the issuance of the permit and found them to be "dry" or have very little water. Due to the cost associated with drilling additional wells or "hydro-fracting" the existing well/s, the owners have installed a water haul/storage system. The water storage system consists of a Greer Tank 1000 gallon polyethylene tank and a transfer pump to supply water to the house. The storage tank and transfer pump are located in the garage. The 1000 gallon tank has been marked with `Potable Water Only" label (see attached photos) and attached is the cutsheets from Greer Tank showing the tank meets NSF certification. Attached is also a completed application sheet. The water storage system has been sized for 3 bedroom residence. Even though the septic system is sized for 4 bedrooms, the house has only 3 bedrooms. Attached is a recent appraisal showing this to be true. We are also requesting a COSA to be issued at this time. Based upon a phone conversation with Jay Crewdson in your department, water samples are not required for this type of system since the water source will be from approved public water system. It is our understanding the owner will be hauling his own water in from an approved public water system using a portable water storage tank in the back of his truck and will transfer the water into the water storage tank in the garage using a transfer pump. Based upon this information, it is our opinion the potable water hauling and stcAage system meets AMC 15.55.070. The proposed system will serve a 4 -bedroom single-family residence. Soil logs, design calculations, a site plan, design drawings and construction specifications are enclosed for your review. The waivers request are as follows: A reduction of the separation distance from the Advanced treatment unit to the new Class C Well on Lot 84 as detailed above from 150 feet to 135 feet. This is based upon the engineers recommend- ation and the analysis conducted the waiver does appear to be protective of public health. A reduction of the separation distance from the planned reserve field area to the new Class C well, on Lot 84 as detailed above, and in the application is reduced from the 150 foot distance to 100 feet. This reduction is based on the engineer's recommendation, the test results from the well, and based upon the analysis conducted. The information appears to indicate the development will be protective of public health. Please note that all waivers are conditional and should the wastewater treatment system or part of this system is found to be failing or determined as endangering public health, the waiver is rescinded and corrective engineering action will be required. This approval does not imply the granting of additional authorizations nor obligate any state, federal or local regulatory body to grant required authorizations. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. 6 It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severahi!ity. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement.
