RE: Lot 20 C-2 Nadine Subdivision
Gentleman:
We represent Charles and Barbara Scevers, owners of the
following described real property:
Lot 20 C-2 Nadine Subdivision according
to Plat No. 67-133, being within the
Anchorage Recording District, Third
Judicial District, State of Alaska.
The Scevers have requested approval for individual water and
sewer facilities, which has been denied due to the distance
between the well on the subject property and the "log crib"
cesspool. Apparently, the distance between the well and the
cesspool is approximately 85 to 87 feet, and apparently the
required distance for a duplex would be 120 feet. The
purpose of this letter is to request a waiver of the require-
ment of 120 feet between the well and the cesspool.
The factual background of the property is as follows. Mr.
Cecil Holland (local business telephone, Elmendorf Post
Office, 752,3515) begun construction on the property in 1967
and finished the basic structure in 1968~- The well was
drilled in 1967. Mr. Cecil Holland and his wife lived in
the bottom half of the building for four or five years. In
1970, Mr. Holland finished the upstairs portion of the
building, and approximately from 1972 on he and is wife

lived in the upstairs portion and rented out the bottom
portion of the building. Therefore, from approximately 1972
to the present date, the property has been used as a duplex.
Additionally, the property is owned R-2, such that duplex
use is within the zoning requirements.
At some time between 1972 and 1975, Mr. Cecil Holland and
his wife were divorced, and Mr. Cecil Holland's exwife and
her new husband (a Mr. O'brien) subsequently occupied the
property. On approximately September 11, 1975, Mr. and Mrs.
O'brien sold the subject property to Charles and Barbara
Scever. At that time, Charles and Barbara Scever had no
money, but had a small equity in a house in California.
They traded their equity in the house in California as a
down payment on the subject property and executed a wrap-
around mortgage in favor of the O'briens, such that there
was no new financing required in 1975 and no requirement by
any financial institutions for an approval of the sewer
system.
The Scevers lived on the property for approximately three
years, and they own it to this date. It was sold to them
through the efforts of a real estate salesman, Mr. Steve
Holland (local 'telephone 2764346), who is the son of Cecil
Holland and Mrs. O'brien. The property was represented to
be usable as a duplex at all times.
In approximately, November, 1978 the Scevers moved back to
California and listed the property for sale. On the strength
of their listing agreement, they borrowed approximately
$20,000.00 on a ninety day note from a bank in California,
and used that money for a down payment on a house in California.
That note has been extended several times, and at this time
the Scevers are under pressure from the bank in California
to satisfy that note, which they cannot do until this property
is sold.
In the sun~er of 1979, the Scevers had an earnest money
agreement to sell the subject property, on a deal whereby
the buyer would obtain new VA financing, however the contract
was not closed, due to the inability of the Scevers to
obtain approval of the septic 'tank system on the property.
The subject property has been used for a duplex for approxi-
mately seven years, and in that time there has never been
any contamination of the water from the sewer system.
Bacteriological tests taken in 1968 showed no contamination;
a similar test taken in the fall of 1979 was also negative.

Additionally, the undersigned spoke with the gentleman who
drilled the well, and he expressed the opinion that due to
the aquifers in the area, it would be impossible for the
septic tank system to contaminate 'the ground water from
which the well was drilled. The well was drilled originally
to a depth of approximately 119 feet, and apparently due to
an inadequate flow, was extended to 130 feet. The well was
drilled by Ken Johnson (local telephone 243-7893) who is
still around and is still in the well drilling business,
however he has been unable to locate the well log for the
subject well. However, he remembered the particular lot and
well in question. Further, Mr. Cecil Holland indicated that
all he ever received were billings on the well and that he
never did have a copy of the well log.
Barbara Scevers is in Anchorage at this time trying to get
the property rented and/or sold, and there is a certain
amount of urgency with respect to resolving the present
problem.
Attached to this letter in support of this application for
waiver are the following documents:
I. Subdivision plat showing subject property.
II. As built survey showing location of house.

Sketch by Robert C. Pratt (Municipality
Department of Health and Environmental
Protection) showing distance from subject
well to adjoining cesspools or leaching areas.
IV. Bacteriological Water Analysis dated 4-7-68.
V. Bacteriological Water Analysis dated 9-25-79.
We respectfully request a waiver of the distance requirement.
After obtaining the waiver of the distance requirement, we
would propose immediately to have the septic tank pumped for
maintenance purposes, and also to verify J. ts size, and we
would additionally have an adequacy test performed to determine
how the system is functioning.
This letter is initially to the Department of Health and
Environmental Protection for the Municipaltiy of Anchorage,
with the understanding that after the ir recommendation for
or against the waiver is made, they will forward it to Mro
Starr at the State Department of Environmental Conservation.

required in order to make a decision, please contact the
undersigned by telephone. Further, it would be appreciated
if the parties granting or denying this waiver would notify
the undersigned by telephone in order that Mrs. Scevers can
determine when she might be able to return to California.

There are three(3) options you have in order to receive a
health approval from this office.
(1)
Install a 2,000 gallon holding tank. You will need to
send this department a request for waiver for the
installation of a holding 'tank. ]if approved, you may
install a 2,000 gallon holding tank.-
(2)
You may sell the residence as a single family dwelling.
If so, you will need to have the septic tank pumped__
for maintenance purposes and also to verify its size.
You will also need to have an adequacy test performed
to determine how the system is functioning. If the
tank is not the correct size or if the seepage system
is tested and found to be inadequste, an upgrade will
be required. Prior to the upgrade a soils test would
be required so that a permit can be issued by this
department.
(3)
You may also petition for waiver from the State Department
of Environmental Conservation. The waiver request should
include the distance separation between your well and your
septic tank and seepage area. It should also include the
distance between your well and any neighboring sewer system.

If the system is ~cepted as a duplex, you will still need
to have the septic tank pumped and the adequacy test performed
and have either or both upgraded if they are not adequate.
This department would provide information to the State should
you choose to ask for a waiver on the existing sewer system.

This department can not approve your request for individual
sewer and water facilities until the following have been
completed:
(1)
Pump the septic tank for maintenance purposes and
to verify its size. }{ave the pumper put the number
of gallons pumped on the receipt.
(2)
The distance between your well and leaching area is
95 feet. It should be 120 feet, because the well is
semi-public the leaching area will need to be moved.
A permit will need to be obtained from this office
for the upgrade. Prior to a permit being issued a
soils test will need to be performed.
(3) The water analysis report be delivered to this office
from Chem Lab, 5633 B Street, for our review.
