Dear Mr. Weaver: This request addresses the vacation off two easements: o Public Land Order (PLO) easement over the above lots 250A, 242A, 245A o Section line easement over the southerly 55 feet of the above lots 242~ 245 and 245A PLO Easement The northeasterly boundary line of lots 250A, 242A and 245A is the centepline of the Old Seward Highway. These lots were originally covered to their full 150' depth by the P.L.O. easement fop roadway purposes. In 1984, the State of Alaska vacated the southwesterly 75' of the P.L.O. easement by Commissioner's Deed of Vacation (r~corded in Book 1129~ page 470), retaining the easement over the 75! strip ad3acent to the highway. The Official Streets and Highways Plan identifies this portion of the Old Seward Highway as a Type I collector¢ requiring 80' of right-of-way (40' on the sub3ect lots). There are no plans to upgrade the road and in view of the limited area served by it, the present P.L.O. easement width of 75' (on these lots) is in excess of the public need. We ape currently requesting the State of Alaska to issue a Commissioner's Deed of Vacation fop the 55' wide strip of these lots that lies beyond 40' from the centerline of the road. The intent of this request to the Platting Board is to also vacate any Municipal roadway easement rights that may exist 4040 B STREET · ANCHORAGE · ACASKA ' 99503-59~9 ' 907/562-2000 '1 Hr. 3erry Weaver November 25, 1987 Page 2 under the P.L.O. to that portion of these lots lying more than 40' from the centerline of the road. Section Line Easement The subject eeetion line easement covers the southerly 33' of the above lots 242, 243 and 243A as shown on the attached map. This 33' wide easement would, in theory, have provided access not only to the petitioner's lots but also to those lots lying to the west and to the land adjacent to the south of petitioners land. The easement is very unlikely to be used for roadway purposes at any time in the future. The property to the south is in the Potter Harsh State Game Refuge. Those properties west of the petitioner's lots presently take their access to the north to the Old Seward Highway. The terrain along the easement would prohibit road development in the future. The easement cuts diagonally across the bluff surrounding Potter Marsh and rises approxistely 92' in elevation along the 550' long south line of the subject lots. Cross-slopes along th£s portion of the easement range up to 3~ percent. We are concurrently requesting a Letter of Non-Objection to this vacation from the Alaska Department of Fish and Game (in thelr role as management agency for the Potter Harsh Game Refuge). We feel it is clear that the subject section line easement is in excess of the public need and, in fact, would be unusable for purposes of constructing a public roadway. During the concurrent replat process, the use of a portion of this easement area for utility facilities would be resolved.
