Per conversations with the owner, they would like to replace their existing septic tank. We are proposing to decommission the existing septic tank and install a new 1250 -gallon HDPE Greer tank rated for 10' burial. As can be seen on the attached design, the existing septic tank and drainfield is off property (utilizing a State of Alaska DNR "non- compatible use permit") and outside the 100' well radius. Per discussions with Rebecca Carroll at the MOA onsite department, the MOA will allow the tank to be installed in the same place as the existing tank, off property, without amending the existing DNR permit. Encroachment. Permit. Chugach hereby authorizes Permittee to continue the existence of the Encroachment in its existing location subject to the covenants set forth in this permit. 4. Indemnification. Permittee shall indemnify and hold Chugach harmless from any claims for personal injury, property damage or other loss arising in any way from the continuation of the Encroachment. 5. No Expansion or Increase. Permittee shall not in any way expand or increase the extent to which the Encroachment occupies any of the real property encumbered by the Easement without the prior written consent of Chugach. Chugach has no obligation to provide such consent. 6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in the future give rise to any interest or estate in the real property subject to the Easement or any other real property. Without in any way limiting the foregoing, Permittee acknowledges that the Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the permission of Chugach for purposes of the common law doctrine of adverse possession. This permit creates no interest in the real property subject to the easement. 7. Modification of Utility Facilities. If the electric utility facilities located within the Easement are upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of Chugach's total costs for such modification which is reasonably attributable to accommodating or preserving the Encroachment. If such payment is not made within thirty (30) days of written demand for same, Chugach may terminate this permit in accordance with paragraph 9, below. Encroachment Permit - Page 2 of 4 8. The obligations ofthe Permittee arising from this permit shall be covenants running with the land which shall burden the Parcel and the Permittee's interest in the land subject to the Easement and shall benefit the F,asement. 9. Termination. Chugach may terminate this permit after the giving of thirty (30) days written notice of such termination if.- a. f: a. The Encroachment is enlarged, increased or extended within the real property affected by the Easement. b. The Encroachment is damaged by any means to an extent of more than thirty percent (30%) of its replacement cost at the time of destruction. Permittee fails to make the payment described in paragraph 7, above. 10. Term. This permit shall, if not sooner terminated by Chugach, expire forty (40) years from the date hereof. 11. Entire Agreement. This written permit constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all other prior or contemporaneous agreements, oral or written, between the parties. TO HAVE AND TO HOLD the same until the above described land shall no longer be used for the above-mentioned purpose and subject to conditions and reservations elsewhere set forth herein. Upon abandonment, termination, revocation or cancellation of this indenture, the permittee shall within 90 days remove all structures and improvements from the area herein granted, except those owned by the grantor, and shall restore the area to the same or similar condition as the same. was upon the issuance of this permit. Should the permittee fail or refuse to remove said structures or im- provements; within the time allotted, they shall revert to and become the property of the grantor. However, the permittee shall not bye relieved of the cost of the removal of the structures, improvements and/or the cost of restoring the area. Provided further, however, that the grantor, in his discretion, may alter or modify the requirements contained in this provision if it is to the best interest of Alaska to do so. The permittee shall utilize the lands herein granted consistent with the purposes of the proposed use, as revealed by the application. therefor, and shall maintain the premises in a neat and orderly manner and shall adopt and apply such safety measures as shall be necessary, proper and prudent with respect to the use to which the land is subjected. No standpipes but two access holes covered with concrete lids. Crib is 13 feet deep and had 45 inches of liquid. On Kov. 12th. water was added to the crib. The well yielded 150 gal. in 20 min. the it run cry. The house is located to high up on thr hillside to be served by a water truck. The 150 gal caused the water level in the crib to raise 2 inches. Within 20 min the level was back to 45 inches. Test .result. Due to the lack of sufficient water only 150 gal was used to test the system. The absorption system passed this quantity of water in 20 min. Some of the major problems which are encountered in operating and maintaining these supplies are created by debris and turbidity encountered at the waterworks intake following spring thaws and per/ods of heavy rainfall. When practical, arrangements sbould be made to remove this material before it reaches the intake. Experience has demonstrated that this matefiai can be removed successfully, especially when small volumes of water are invoh, ed, by installing an infiltration gallery at or near the intake. Where soil formations adjeining a stream are favorable, the water can be intercepted by an infiltration gallery lees(ed a reasQnable distance from the high-water level and a safe distance below the ground surface. Ti~e gallery should be installed so that it will intercept the flow fi'om the s!ream after flowing through the intervening soil formations between the str¢am a~td infiltration gallery. A typical installation generally involves the construction of an underdrained, sand.filter trencl~ located parallel to the stream bed and about 10 feet from ihe high-water mark. The sand filter is usually located in a trench with a minimum width of 30 inches and a depth of about I0 feet. At the bottom of the trench, perforated or open joint tile is !aid in a bed of ~'ave! about 12 h-iches in thickness with about 4 inches of graded gwavel located over the top of the tile to support the filtering material. The embedded tile is then covered with clean, coarse snnd to a minimum depth of 24 inches, and the remainder of thc trench backfilled with fairly impervious material. The collect/on tile is terminated in a watertight, concrete basin from where it is diverted or pumped to thc distrib,ation system foIlowing chlorination. Where soil formations adjoining a stream are unfavorable for the location of an infiltration gallery, the debris and turbidity which are occasionally encom~tered in a mountain stream can be removed by constructing a modified infiltration ga!leD,-slow sand filter combination in the stream bed. A typical installation involves the construction of a dam ac[ess the stream to form a natural poe! or the excavation of a pool behind the dam. ?he filter is installed in the pool behind the dam by laying perforated pipe in a bed of ~rad~ gravel whici~ i~ covered by at least 24 inches of' clean, coarse sand. Where tile quantity of ground water is inadequate or the quality objectionable, and where a municipal water supply is not available, a cistern supply may be acceptable as a limited source of water. Because rain water is soft, little soap is needed when used for laundry purposes. On the other hand, rain will wash dust, dirt, bird droppings, leaves, paint, and other materia! on the roof into thc cistern nnless special provision is made to bypass the first rain water and to filter the water.
