Dear Mr. Cross:
Subsequent to our meeting at your office, our client, Mr. Arvid Miller, has decided to drill a new
private well in the location shown on our revised plan.
This location is 100' distance from all documented septic systems, and the owner of Lot 39 has
stated there is not a septic system on his lot. We have to rely on his verbal statement given to Mr.
Miller as there are no records for his dwelling, and the lot has so many storage buildings and
general auto parts, that it can not be completely visually inspected.
Our new site plan allows us to place (he septic in its original location, utilizing the 5' lot line
waiver applied for in our March 1995 permit application. The wastewater system specifications
and design remain the same.
The existing well will be abandoned by the following procedure:

Cut off casing four feet below ground level
Fill welt with clean gravel and sand to a level of 10 feet below top of casing
FiLl final 10 feet with Bentonite grout mix
Weld 0.25 inch cap over top of casing
Backfill hole

The subject permit, issued November 7, 1994 by this office for a
single family well and/or on-site wastewater system, has
expired as of November 7, 1995.
A new permit must be obtained from this office for a well
and/or on-site wastewater system NOT installed by the
expiration date.
If you have drilled the well, a well log must be sent to
this office for documentation of the installation and to
close the permit.
If a licensed Professional Engineer has inspected the
installation of the on-site wastewater system, the original
as-built inspection report must be sent to this office for
review, approval and documentation. All inspection reports
must be submitted within 30 days of construction completion.
When applying for a new permit, the fees are: $320.00 for an
on-site wastewater permit; $120.00 for a well permit and
$440.00 for a combined on-site wastewater and well permit.

Narrative & Permit Application
Dear Mr. Cross:
On behalf of our client, Mr. Arvid Miller, we are requesting re-issue of the septic permit for the
property referenced above. The original permit, number 93-0400, application was provided by
Constructing Engineers. Minor modifications in the layout and total depth have been made, based
on our site evaluation. A new test hole was excavated to 18' and a monitor tube was installed.
We were unable to verify the recorded total depth and water table in the original test hole,
possibly due to a blocked monitor tube. A new percolation test was not accomplished as it was
determined by your office that the signature on the original percolation test and soil log was valid.
A site plan showing the location of the both test holes and the proposed layout is attached.
Due to the small size of the lot and the existing well location, a waiver and variance of separation
distances are requested. The design requires a variance of the normal 50' horizontal separation
distance from the field to a downslope cutbank. The gravel cutbank has a 10'-15' vertical drop
at a slope of 90-100%. The variance required will be 35' from our replacement site to the
cutbank. A waiver of the normal 10' separation distance from field to lot line, to 5', will also be
required. The lot contains an existing well which was installed under permit number 88-0165.
During our investigation, it was determined that there is an undocumented septic system on
neighboring Lot 36 that is 76'-87' from the subject well that was not noted on the original site
plan.

LEGAL:

Delucia Lot 40
1. The septic plan is for a single family residence only.
2. The drawing and or site plan shall be a part of this specification.
3. All materials and workmanship shall meet the Anchorage Department of Health
requirements.
4. All soil tests are advisory to the design and are to be verified or modified in the
field by the engineer.
5. All excavations and depths are advisory and are to be verified in the field by the
contractor to meet Municipality of Anchorage requirements.
6. It is the responsibility of the owner to obtain all necessary permits or easements
and to locate any adjacent multi-family wells.
7. The excavation is to be exactly in the area shown on the site plan, any deviation
requires engineer approval.
8. It is always recommended that a surveyor locate the nearest lot line position and
the location of any easements.
1. Tank shall be an MOA approved two compartment septic tank, a minimum of
1,000 gallons in capacity.
2. Tank shall be installed level.
1. The trench is to follow the natural land contour to maintain uniform total depth of
the trench bottom.
2. The bottom of the trench shall be level, plus or minus 1.5".
3. The total depth of the trench excavation is not to exceed 12' at any point.
4. The leach line is to be laid level, total variance not to exceed 0.03'.
5. The trench gravel is to be covered with typar fabric material.
6. Soil or combination of soil and extruded board insulation to a depth of 3' or
equivalent is to be placed over the leachfield.
7. The area over the trench is to be finish graded to prevent ponding of surface water
runoff.
8. The septic tank and leachfield must not be closer than 100' to any existing private
well, 150' to any Class "C" well, or 200 feet to any community well.
RECOMMENDED I.EACHFIELD DIMENSIONS:
TOTAL DEPTH = 12' GRAVEL DEPTH = 8.5' under pipe, 2" over pipe, 9' total
TRENCH LENGTH = 22 TRENCH WIDTH = 3'
SOIL RATING = 1.2 GPD/ft2 BEDROOM CAPACITY = 3
SEPTIC TANK = 1,000 gallons
Twenty-four (24) hours notice required for all inspections.

Dear Mr. Cross:
I atiempted ~o de~'mine m~xe 0~. on the encroaching s~ic system on Lot 36 that we discussed
yesterday.. The lot has a fence around it with a sign, "Protected by shotgun 3 nites a week you
guess which hires." So, I didn't enter the property. Curt was able to enter it last year and took
the field notes by which our septic location area was determined. He also contacted the owner
for velification of location and the estimated date of construction was 1972. These are attached.

Dear Mr. Miller:
This office recently received information that the well constructed on Lot 40 Delucia
Subdivision on April 20, 1987 is encroaching on the wastewater system serving Lot 36
Delucia Subdivision. The wastewater system on Lot 36 was in place at the time you
constructed the well on the subject lot. Municipal code prohibits the construction of a
water well closer than 100 feet from a wastewater system.
As a result of this recent discovery, this office is rescinding the subject permit number
SW940427 until the separation problem between your well and the neighboring
wastewater system is corrected. This letter will serve as your notification that
construction of the proposed wastewater system which the subject permit was issued for
cannot proceed at this time.

Dear Mr. Aziz:
This letter is in response to your letter of June 1, 1988. As
we discussed on several occasions during August and September
of last year by phone and in person, On-Site Services has
several concerns regarding the permit application submitted by
you for the subject lot.
These concerns are: The inability to meet technical
requirements of the Ordinance for a standard on-site wastewater
disposal construction permit, and the existing problem with
elevated nitrates in the drinking water supplies in the
immediately surrounding area of the subject lot. We also
discussed at this time that the technical requirements the
subject lot could not meet may possibly change because several
amendments to the ordinance were scheduled to be heard in
October by the Anchorage Municipal Assembly and most likely
adopted. To this date the Assembly has moved to postpone the
amendments until a special advisory committee could review and
recommend changes to the existing ordinance.
In the interest of expediting the permitting process for the
subject lot, I recommend that you meet with myself, Susan
Oswalt, and Lee Browning on June 15, 1988, 3:00 p.m., at the
Department of Health and Human Services. If this time is not
convenient for you then contact me so we can reschedule.

Dear Gus:
The on-site wastewater disposal permit application for the
above referenced property was submitted to your department on
August 26, 1987 together with engineered construction plans and
design calculations for the system. Your department has not
reached a decision about this property since August of last year.
Reference is made to my letter dated August 26, 1987
addressed to Daniel Roth of your Department. Since September of
last year I have had numerous discussions with Dan Roth, Steve
Morris and Robby Robinson of your Department about this permit
application. They maintain that there is a problem with the
replacement area for this property, due to inconsistencies in the
present ordinances. In our design, we considered the replacement
area to utilized the same type of disposal system as the
original, which requires less area than a convential system. I'm
still not convinced that there is a problem here. My belief is
confirmed by the fact that 15.65.040 Paragraph 4 allows an
engineered alternative in lieu of an on-site replacement area, as
applicable to this property. Nevertheless, to date we have no
statement of a decision from your Department, or even a reply to
my August 26, 1987 letter concerning this property. I would like
to get this resolved.
During my last conversation with Robby Robinson on April 14,
he indicated that there is a way to solve this problem from your
Department's standpoint, by requiring the replacement area to be
constructed at the same time as the original disposal field. If
the proposed ordinance amendments, which are now approved by the

Assembly task force and recommended for adoption, were in effect
today, there will be no problem with our proposal for this
property, and I am sure that Robby Robinson of your Department
will concur with this conclusion. Frustrated as we are we would
like to proceed in the manner that Mr. Robinson suggests.
The property owner has a major problem at his hands right at
the moment: A residential structure was moved to the site last
year, which now sets on temporary timber pedestals. This is very
unsafe, and nothing can be done about it until the water and
wastewater disposal permits for the property are granted, as a
result of a stop-work order issued by the Municipality last year.
The property owner has done everything that he can since that
time to obtain the required permits. Your department has taken
an unreasonable length of time to come to a decision on this
case, either approving or denying the permit applications. I am
sure you will agree that there is no basis here for a denial.
We ask that you review this case as promptly as possible. I
will be happy to answer any questions that you may have at your
convenience. Please give me a call.

Manager for On-Site Services, a permit for the installation of
an on-site wastewater disposal system is being issued. After
the M.O.A. Legal Department reviewed the On-Site Wastewater
Disposal Ordinance, they determined that in defending the
ordinance a permit could be issued or could not be issued.
With this finding Lee 8rowning ordered a permit be issued to
Arvid Miller for the installation of both the o~iginal and
replacement absorption bed to be installed at the same time for
our assurance that the replacement site will be available in
the future.

Dear Mr. Roth:
Pursuant to our recent discussions, the design and construction drawings
for the above referenced wastewater disposal system have been revised per your
requirements. The design and construction plans for the replacement disposal
area is now included in our submittal, and a note pertaining to the minimum well
clearance has been added to the drawings. Attached are three sets of blueprints
for the above and one copy of our revised calculations for your information and
records.
As we have discussed, I have strong reservations about the alternating use
of disposal fields. I prefer that the primary disposal bed is used for 15 to
20 years, until the sand bed looses its treatment capacity as a result of biomass
build-up. This can be determined from samples taken at the monitering well.
Only then, the replacement disposal bed should be activated while the primary
sand bed is replaced and the subsoils are allowed to relax for a period of 5
to 10 years. I will advise my client to keep a copy of this letter readily
available at the property, and place a lable at the moniter well with reference
to this letter and where to find it.
With all the hassle that we have gone through over this property, I trust
that you will do the best to expedite the permits for this property, and I hope
that the information transmitted with this letter is sufficient for your information
and records. Please call at your earliest convenience if there are any questions.

Subject: Development of Lot 10 Delucia Subdivision
Dear Mr. & Mrs. Miller:
Recently it has been brought to our attention that a well has
been dug on the above mentioned parcel. After a site visit it
was confirmed by our office that a well did exist and the tot
appeared to be in development stages.
According to the Anchorage Municipal Code Chapte~ 15.55.040,
"It is unlawful for any person to construct a ground water well
unless he holds a valid permit issued by the department in the
name of the property owner for the specific construction
proposed." In addition, Anchorage Municipal Code Chapter
15.65.020B requires, "A lot or parcel served by a well or
public water supply must have a sewage disposal system
conforming to this chapter, or a public sewer."
To avoid further legal actions the well must be either
abandoned or the proper permits for on-site septic and well
installations obtained from this department. Please contact us
