In fact, the owner's driveway and parking area also are not within the lot line. I visited the lot, and it appears that the way the house is built, that without a doubt, the system encroaches on the right of way. However, by the traffic configuration it does not appear that this cul de sac will ever be developed, as laid out on the plan. This subdivision is fully developed, and no additional housing is anticipated. The original soil test showed 85 sq ft per bedroom and it was built for a 4 bedroom house. The house is, legally, only a 3 bedroom, and was sold and the Health Authority was for such. From the swing ties that we are able to determine that there is only approximately 4 1/2 to 5 feet of the system that would extend beyond the lot line. When we did the adequacy test on 13 June, 1989, the trench was dry. And after the introduction of 840 gallons of water, it was still dry. There was no rise at all in the liquid level in the system. Therefore, in my professional opinion, the reduction of the area from 352 sq ft to 26 sq ft will have no affect on the operation of this system. There are no sewer systems nearby that the issuance of a lot line waiver of zero feet would affect. The soils are such that it would also not have any affect.
