The submitted "Documents of Construction" shows that a 1500 gallon step tank and a 66 foot long by 8 foot effective depth deep trench on -lot disposal system was installed to serve a four bedroom duplex on Lot 2, Benjamin's Birchwood Estates Subdivision. My review of the Department's file on this property revealed that on May 8, 1984 a final operational certificate was issued by this Department for the existing Class C public water system. Then on June 18, 1984, the Department issued a separation distance waiver the separation distance from the Class C public water system source well to the existing soil absorption system [deep trench] from 150 feet to 148.5 feet. In October 1999, the Department modified the State Drinking Water Regulations that reclassified water systems serving duplexes from Class C public water systems to private water systems. This resulted in the minimum separation distance between the source well and wastewater disposal system serving a duplex to decrease from 150 feet to 100 feet. With the reclassification, the separation distance waiver issued on June 18, 1984 is now not required. The final operation certificate issued on May 8, 1984 for the Class C public water system is no longer required. All information concerning the separation distance waiver and the final operation certificate will be retained in the Department's file on this water system. The submitted "Documentation of Construction" verifies that the new wastewater disposal system was installed in accordance with the minimum separation distance requirements found in the State Drinking Water and Wastewater Disposal Regulations. The level of nitrate (as nitrogen) in the water being provided to the residents of the duplex is 4.23 mg/L. Alihougli this level is less than the maximum contaminate level of 10 mg/L, found in the State Drinking Water Regulations, it is still higher than normal non -impacted ground water. Based on the existing nitrate level, I suggest that a water sample be taken once every two years between January and March to determine if the nitrate levels do increase. If the nitrate levels are increasing, this sampling will allow your clients time to install a water treatment unit. The "Documentation of Construction" will be included in the Department's file on this property. Thank you for your cooperation.
