What we have done as a temporary measure is.to vacat~ one of the apartments in the duplex, thereby following a suggestion made by ~our department earlier I believe in that a single family residence creates legal problem. In the meantime we are evaluating the merits of drilling .a well there , and I think this is probably the way we will go. There are some development reasons for drilling a well, and perhaps we might just as well drill a well now ~ and have water for the . future there for all the houses. So we will be back to you in another month or so informing you of the final disposition of the water supply problem. But for now, I believe we have met all the requirements of the law. We have not been able to complete our studies in this case because of the particular timing during the past month~, and since we can't seem to resolve the question, we are requesting a one year extension on the matter until we can make a comprehensive study of the requirements and the needs-;, To date the questions raised have been very complex. The regulations were included and we thank you for them. It does appear that we will have to go to the full code in order to satisfy the questions we have. Is a duplex considered to be an apartment building for purposes of this code? There is no mention of the grandfather rights in the regulations that you submitted. It might be cheaper to close one side of the duplex down, if it is covered under this Code, and make it a single family residence, which apparently then would satisfy the code. It should be noted that the installation of the system was done properly and under supervision of your office several years ago, and has been functioning well ever since. Further, chemical testing has been carried out consistently on the water from this supply system, and has always proved satisfactory, and never has shown any problems. Requiring immediate compliance with the code would force at least one of these low income families to move out, creating an additional problem in the community. i~k~ATI-[~INc. The cost for installation of a system here may be unreasonable, and might have some contractor's estimates that the drilled well required might not be successful in light of past experiences. Before we embark on any costly study regarding this water system, we need to know if the Grandfather Rights since the water system preceded the law by several years. Please clarify that particular point in your next letter. Please include a copy of the law so that we will be able to answer all questions posed to us by our membership° If indeed we have no existing rights under the law to continue as we have been operating, and that can be ascertained without any question, then we would of course proceed immediately with the methods suggested in your letter. We of course are reluctant to engage an engineer at this time, although we have considered installing a drilled well in the past. Please provide us with the information as quickly as you can. Any costs encountered in this of course would be passed on to our rentors who are most concerned, but if we are required by law to do it, then we should do it.
