Based on this review, final operational approval is hereby given for the wastewater system, which consists of a biocycle wastewater treatment system discharging to a deep trench. Any future expansion or modification of the subject project will rewire additional approval from this office. An Operation Certificate, constituting this approval, is enclosed. These approvals do not imply the granting of additional authorizations, nor obligate any federal, state, or Iocal regulatory body to grant required authorizations. Health & Human Services Subject: Lot 64A, Sunny Slopes Subdivision, Eagle River, Alaska, ADEC Project Number 9821-WW-293-107 Dear Mr. Yeargan: : ' ' This is in response to your letter, received in this office on April 30, 1998, in which you stated the Council's position regarding the installation of an on-site wastewater treatment and disposal system on the above-referenced lot. In preparation to respond to your concerns, I completed the following: Reviewed the Department's file regarding the proposed wastewater treatment and disposal system for Lot 64A, Sunny Slopes Subdivision; Discussed municipal ordinances with Municipality of Anchorage, Department of Health and Human Services staff; and Discussed the soil logs with the developer's Professional Engineer, who designed t~e proposed on-site wastewater'treatment and disposal system. Based on the above, I have not been able to confirm that a wastewater treatment and disposal system would not be allowed for a single family home on this lot. For further clarification regarding the installation of a wastewater treatment and disposal system to serve a single family residence or when structure would be required to contact to public sewer, you will need to call Mr. James Cross; P.E., of the Municipality of Anchorage, Department of Heath and Human Services; Since the proposed development was a duplex, the design and approval of the wastewater treatment and disposal system was covered by this Department. The design engineer submitted the proper information to show that the site was suitable for the proposed wastewater treatment and disposal system. The information provided also showed that a replacement disposal site Mr. Jim Yeargan 2 May 8, 1998 could be installed. Departmental engineering staff, along with the developer's Professional Engineer, had concerns regarding the development of this property. As a result, the developer agreed to provide additional treatment to the wastewater that would be generated by the residents of the proposed duplex. Based on the results of a two-year monitoring program, the proposed treatment method can treat the wastewater to secondary treatment levels. Therefore, the treatment method was approved by the Department. The Department reviewed the submitted soils information and determined that additional conditions would be implemented to ensure public health. Issuance of the construction approval was conditioned upon the provision additional wastewater treatment. Further, there is a requirement for operation and maintenance contract for the treatment system. Overall, my review of all the information indicates that the proposed wastewater treatment and disposal system was designed to protect the safety of the public and the environment. In regards to your request on having the existing Construction Certificate for Domestic Wastewater Disposal System for Lot 64A, Sunny Slopes Subdivision rescinded, I have to decline this request. As noted above, the Municipality of Anchorage does not have the authority over duplex or when they must be connected to public sewer. This is absolutely inappropriate to community planning and health. A septic system would not be allowed on a lot this size for a single family residence and should not be allowed for a multi-family residence. Present sewer service is available within 350 feet of the proposed development. This Council is opposed to new development that does not conform to urban water and sewer, and he~h standards in our community. Especially new development that is as close to our community center as this development is. Lot 64 and 65 of Sunny Slopes Subdivision were basically built of fill and waste during the construction upgrade of Monte Road. It is unlikely that these lots could safely support a septic system without causing future health concerns. Them are safety concerns arising from the questionable stability of the slope at the rear of the property where the septic system is being hnstalled. This system should never have been allowed to begin with. Due to the slow rate of perco- lation, less than 2 inches in 10 minutes, it was decided to allow the material to saturate over night. On August 20, 1966 a second percolation test ($2) was performed in an excavation previously backhoed on the subject site. The test data are shown on the attached sheets. The percolation rate in the second test was determined to be greater than one inch per minute.
