We are proposing to install a new septic tank and a new drainfield. The system will be sized for 4 bedrooms. The existing septic system and wells on the lot have been taken out of service. The well near the house will be permanently decommissioned and the well near the road will be brought back into service. Included with this letter is a permit application and design package, including plans, and calculations. A test hole was excavated and revealed good soils with no groundwater encountered. The Homeowner may install the septic system himself and will submit the appropriate paperwork in advance of doing so. The proposed improvements will have no apparent adverse impacts on adjacent properties. A test hole revealed silty soils on the lot. Maintenance, Repairs and Alterations. e er is required to read, understand and initial each section) hroughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). �61 Owner agrees that only maintenance and repair personnel approved by the Municipality tY or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement. The details shown below indicate all of the requirements have been satisfied. 1. Septic System: a. Septic tank: It was completely removed from the property and disposed of at the MOA landfill. The hole was backfilled to be level with the existing ground surface. b. Drainfield: Originally it was thought to be a crib, but was discovered to actually be a trench, which was abandoned in-place. c. Asbuilt Survey: A copy of the existing Lintner Lot 2 asbuilt (Duane Mark Seward, dated 1-14-91) is attached to this letter. -2. Water System There are two wells on the property. Both wells have been taken out of service, are currently non -operational, and will not be allowed to be put back into service until a new septic system is installed on the property. The MOA required conditions to render the wells non -operational have been completed as detailed below. a. Well 1 i. Location: In the front yard alongside the driveway, approximately 30 feet from the street. ii. Water Quality: (lab report attached) 1. E. Coli and Total Coliform Bacteria: Negative Note: The initial sample came back positive for total coliform. The well was chlorine shocked by Sullivan Water Wells and resampled. 2. The home is in poor condition and Brian believes the only time efficient cost-effective way to sell the property is to price it to attract buyers who would want to demolish/dispose of the house and build a new one in its place. As such, we will be requesting below that the MOA allow the property to, be sold without a COSA if the listed conditions are satisfied. History 1. Septic System Although there is no documentation on file indicating this is an approved system, it was approved by the department for at least two prior property sales. Currently, the septic tank is substantially collapsed and as well as no longer working properly is also considered a serious safety concern. The water elevation in the drainfield (crib?) is approximately 2.5 feet below the ground surface, which given this is a gravity fed system on a relatively flat lot, it's likely submerged in shallow groundwater and not just plugged by sewage. The septic system is obviously failed and would need to be upgraded prior to any future use. 2. Water System There are two wells on the property. ® Well 1: Per the Executor, it has never been operational during the time his mother owned the property. Currently, the electrical wires to it are cut off and it is not operational. It is approximately 50 feet from the septic system. ® Well 2: It is currentlyprovidingwater to the home and is 100+ feet fromtheseptic system. Required Conditions Due to the poor condition of the home and the condition/issues discussed above regarding the septic and water systems, we are requesting the following conditions be satisfied so that the property can be sold without the need to acquire a COSA. Note: It shows the current location of the septic standpipes and would be helpful information to have when designing a new septic system. 2. Water System The intention is to render the wells unusable until a new approved septic system is installed by a future owner, while at the same time not degrading their potential value to prospective buyers. Further, it is our intention to provide the new owner with the utmost flexibility in deciding which well(s) to either use or fully decommission in accordance with the code. a. Well 1 and Well 2 i. Electrical 1. Remove all excess electrical wiring coiled up inside the well casing and cut it off at least 1 -foot below the top of the casing. ii. Well Cap 1. The septic tank was pumped and verified to have a capacity in excess of 1000 gallons. The drainfield was tested by continuously flowing water through the system at a rate of approximately 10 gallons per minute. During this test the liquid level in the septic tank was monitored as water was added to the system. If the 3 bedroom residence on the property is to house 6 people, the average load on the system can be expected to be 450 gallons per day or .31 gallons per m~nute. During the test, the system accepted 210 gallons in 82 minutes. This indicates an average effluent acceptance rate of approximately 2.6 gallons per minute at the time of the test.
