The purpose of the soils investigation is to document the on-site conditions at the above referenced property as explained in my report dated January 29, 1993. My report responded to the Notice of Violation (NOV) issued by you to Lennart and Louise Augustsson dated December 29, 1992. We plan to conduct the soils investigation during the month of June 1993. The structures on the property are served by an on-site well and wastewater disposal system, neither of which were ever permitted for construction or approved for use by this office. Please be advised this letter will serve as a formal Notice of Violation of: AMC 15.65.020 - Discharging wastewater to a nonconforming and undocumented wastewater disposal system. AMC 15.65.030 - Modification or construction of a wastewater disposal system without a permit. AMC '15.65.040 - Construction, installation and use of an on-site wastewater disposal system that does not conform to applicable codes and regulations. 4. AMC 15.55.050 - Construction of a water well without a permit. Resolution of the above violations will require that you take the following corrective actions: By February 1, 1993 you must retain the services of a licensed civil engineer who will be responsible for evaluating the existing undocumented well and wastewater disposal systems and providing any necessary designs and/or permit applications necessary to bring the waker and wastewater disposal systems into compliance with current regulations. Your engineer must provide a letter to this office indicating a schedule for resolving all system deficiencies. Resolving these deficiencies may require that a new well be drilled and that a new wastewater disposal system be designed and constructed. Failure to satisfy any of the above requirements will result in one or more citations being issued to you. These citations will require a mandatory court appearance. S-9154: USS ~3200 Lot 12D-1 Records in this office show that a sewage disposal system and well for a 3 bedroom single family dwelling were constructed in accordance with applicable codes in 1975. However, MOA appraisal information indicates that this dwelling:is-now being used as a 4 bedroom duplex, in violation of State wastewater regulations. We will require that either the dwelling be restored to single family status, or appropriate certificates ~./~__. to operate be obtained from A.D.E.C. S-9155:· Lots 25 - 27 Heritage Heights Subdivision DHHS has previous soil tests for Lots 25 and 26; we also have complete records for the disposal system and well on Lot 25. However, our files reflect that the well and sewer installation on Lot 27 are undocumented. Our request for information from the property owner in 1979 was ignored. We will require that the owner now supply an appropriate soil test and system documentation by an engineer, and provide a well log. In addition, the applicant must show on the preliminary plat the location of all wells and sewer systems on this development and within 200 feet of the development. 21.15.120 Final Dlat--Filinq procedures, submission recu/irements and conditions. Procedure when final plat corresponds to preliminary plat as approved. A hearing on the final plat shall not be required when such plat essentially conforms to the preliminary plat approved by the platting authority. The final plat shall, in addition~ meet all conditions imposed by the authority in approving the preliminary plat. The final plat map shall constitute only that portion of the approved preliminary plat which is proposed to be recorded and developed at the time. If only a portion of the approved preliminary plat is proposed for final plat approval, such portions shall conform to all requirements of the subdivision regulations. The steps outlined below shall be followed in the final plat: A written statement shall be obtained from the platting officer stating that the final plat being proposed is essentially the same in its physical configuration as the preliminary plat approved by the platting authority. The final plat shall be submitted to the Department of Public Works for final checking and inspection before final approval is given. If requested, a subdivision survey shall be submitted to the Public Works Department with a complete set of field and computation notes showing the original or reestablished corners of the plat and of lots within the plat. Traverse sheets and work sheets showing the closure within the allowable limits of error of the exterior boundaries of each irregular block and lot of the subdivision may also be required. Final approval by the Department of Public Works shall be indicated by a statement appearing on t. he pla~. AMC 21.15.120 21.15-43 (Supp. ~48 9/30/89) Ce After approval of the Department of Public Works, the final plat shall be submitted to the Department of Economic Development and Planning for examination as to compliance with all terms of the preliminary plat as approved by the platting authority. If all conditions have been met, a statement to that effect, appearing on the final plat, shall be signed by the chairman of the platting authority or his representative° The final plat shall not be signed until the documents described in subsection A.4 below have been received. Final approval by the platting authority shall be dependent upon receipt of the following material: a statement from the Department of Health and Human Services stating that all conditions imposed by the department on the preliminary plat and approved by the platting authority have been met. This approval by the Department of Health and Human Services shall not affect any subsequent requirements relating to sewage disposal and water supply as they apply to any lots within the plat; a certificate from the tax collecting official or a note on the face of the plat stating that all municipal real property taxes levied against the property are pa-id in full, or, if approval is sought between January 1 and the tax due date, that there is on deposit with the chief fiscal officer an amount sufficient to pay estimated real property tax for the current year; a certificate to plat shewing the legal and equitable owners (including mortgagee., contract purchasers and fee owners) of the land to be platted, plus all grants, reservations, covenants, deed restrictions and easements of record which may condition the use of the property. A/4C 21.15.120 21.15-44 (Supp. ~43 6/30/86) The platting .authority shall take action on the final plat within 60 days after all required materials have been submitted to be heard, or shall return the plat to the applicant for modification or correction. The reasons for disapproval of a plat shall be stated upon the records of the platting authority. If approved by the platting authority, s~bsections A, C and D shall then be followed in their entirety. Ail decisions as to approval or disapproval of a final plat by the platting authority as s~bmitted under this section shall be final unless appealed as provided by ordinance. Requirements of final plat. The final plat shall be clearly and legibly delineated upon tracing cloth of good quality or on a good quality polyester film (equal to DuPont mylar) .003-inch t_hick matte both sides or a direct positive photographic reproducible polyester .003-inch thick matte both sides. Diazo process reproducible on polyester film or cloth is not acceptable· All lines, letters, figures, certificates, acknowledgments and signat%lres shall be made in black waterproof, acetate ink of good quality (Pelikan T or equal) except that affidavits, certificates and acknowledgments may be stamped or printed upon the plat with black ncnsmearing opaque ink. The plat shall be to a scale of one inch to feet, provided, however, that the platting officer may authorize a scale of one inch to 200 feet upon receipt of a written request for such authorization. The map or maps shall be 18 by 24 inches, 24 by 36 inches, or 31-1/2 by 34 inches, provided that if more than one sheet is required to cover the plat, each sheet shall be of the same size. The map shall show all existing monuments, courses and distances necessary to restake any portion of t. he plat. The allowable error of closure shall not exceed one foot in !0,000 fee~ in the urban area, one foot in 7,500 feet in the suburban area, and one foot in 5,000 feet in all remaining areas of the municipality. Box 196650 Anchorage, Alaska 99519-6650 Re: Heritage Heights Subdivision,.Addition 1 Lot 27A Dear Ms. Oswalt: I was asked to visit the above referenced site to verify an existing septic system. The following are my observations of June 23, 1992: It is my opinion that existing septic system is presently serving two structures. One is a log home and the other is a two car garage with a full office on the second story. Both structures have foundation clean outs. The clean out for the garage does have standing water at its base. The garage was locked and I could not gain access; however, the upper portion appears to be a full time office. I did enter a furnace room in the southwestern portion of the garage. I learned that the structure is plumbed with both water and sewer and both services are in the same entry point. The garage is heated with baseboard hot water heat. The septic tank appears to be approximately 1500 gallons with well over four feet of cover. I am not sure of its manufacture or its rated depth of bury. There is no evidence of a soil absorption field. It is assumed that it extends to the southeast from the septic tank. This will have to be verified by e×cavation~ The site is on a si. ope exceeding 25% and the installation is questionable, at best. The well is in a vault that is approximately six feet deep. The vault is formed by concrete masonry blocks and is both heated and insulated. The well head is in a sump in the base of the vault. The sump is approximately eight inches below the floor level. It is my client's intent to sever the sewer connection to the garage. The internal plumbing fixtures will be disconnected. The water service line will be fitted with a backflow prevention device that will serve the heating system. All other entry points to the water system, in this area, will be sealed. There will be no domestic water service to the garage. Engineers · Planners · Surveyors The well casing will be extended to at least two feet above the floor of the vault. The well wires will be placed in proper electrical conduit and the sanitary seal replaced. We will then continue with the evaluation of the existing system. We will check the integrity of the septic tank, the type and size of soil absorption system, the separation distances and the adequacy. If this method of dealing with this situation meets with your approval, we will continue as soon as possible. At the time I verified the following: 1. There is a complete DHHS record for Lot 25. 2. Lot 26 is vacant. 3. Lot 27 has a house and detached garage. The dwelling was built in 1978 and has an undocumented disposal system and well. There are no permits in our files. As a result of the above information, I requested that the system on lot 27 be properly documented by a registered civil engineer. (See my memo dated 11-7-91). The plat gained preliminary approval on December 4, 1991, with a condition that requirements cited in my memo be met prior to final plat approval. On December 4, 1991 I met with Janice Faiks and Stephen Brown and explained our requirements. As a result of the meeting, I agreed to contact the State of Alaska in Juneau to relay the requirements to them since the state owned Lot 27. I contacted Geoff Whistler, the REO Officer with the state. Mr. Whistler understood our requirements and agreed to see that they were met. The agent for the state, Ed Farnham of E. F. ~ Associates, called me on February 11, 1992 and indicated that all parties had agreed to wait until spring to document the existing system. He stated that Allen Murfitt, P. E., had verified the existence of a septic tank. No written confirmation of this fact was ever received. On June 23, 1992 I received a call from Jack Felton, P. E. He had been hired by Mr. Farnham to provide DHHS with information. During the course of his inspection, Mr. Felton discovered that there was an office over the primary dwelling, and an office over the detached garage as well. Both structures appear to be Page 2 S-9155 connected to the same sewer system and both utilize the same well. He noted that the foundation cleanout at the garage was filled with water. At this point Mr. Felton discontinued his inspection as it was his conclusion that the well and sewer would come under ADEC jurisdiction. His letter of explanation followed our conversation. I had several conversations with Kevin Kleweno at ADEC regarding the status of this lot. I was also in touch with the municipality's zoning office. I attempted to have a zoning officer evaluate the residence/garage/office configuration. On July 29 I was informed that the state would not authorize a visit by a zoning officer as the transfer of property had already occurred. Mr. Farnham wrote the new owners and directed them to contact me for additional information. I spoke later with Mrs. Augustsson and explained all that had previously transpired. Again today I contacted ADEC, and through Michael Lu found that Kevin Kleweno considers the lot to contain a community sewer system and a Class C well, both of which are under ADEC jurisdiction. The only viable solution for returning the status to single family is for all plumbing to be removed from the upstairs portion of the garage. Mrs. Augustsson has already refused to do this. I have also had several discussions with Mr. Ed Farnham, who in turn has contacted the agent for the state, Geoff Whistler. For the record I would like %o state that this office has jurisdiction over private, single family wastewater and water systems only. The new information you have provided indicates that the structures on this lot are not of that category. When this office determines that the use of the.structures falls within the jurisdiction of the State Department of Environmental Conservation (ADEC), we routinely route the review to them. As a result, I have the following comments to make in response to your letter: 1. Prior to final plat sign off, we will still require that the system(s) on Lot 27A be brought into compliance with ADEC regulations or municipal regulations, whichever applies. The process for compliance has been previously outlined to you. If the offices/apartments are abandoned, we will require that all plumbing to and from them, and all fixtures and appliances in them, be removed. We will of course permit the piping of water to serve the heating system in the detached garage. I suggest that you request an inspection by a municipal zoning officer to confirm that this work has been done, as the current use may in fact violate zoning regulations. 2. If the dwelling is to revert to single family status, we ask that the well casing not only be extended, but that the Page 2 Jack Felton pit be completely backfilled. This may necessitate the relocation of the pressure tank to a protected area where it is not subject to freezing. If the well is to continue to serve more than a single family dwelling, you must apply for and .obtain a Certificate to Operate a public well from ADEC. I have been contacted by Mr. Kent Hartzberg to finish the work and obtain the required permits for the well and septic system. On August 17, 1995 we excavated both the tank and the existing drainfield and found that the tank is indeed a 1500 gallon septic tank as made by Greer Tank or Anchorage Tank and Welding. The drainfield was found to be a 5-foot wide trench with less than 12 inches of sewer rock. A visual evaluation of the drainfield concluded that at most the field was sufficient for a one-bedroom residence. A testhole was therefore excavated to design a proper drainfield to serve up to four bedrooms. The soil log and the proposed design is submitted for your review. The NOV also addressed the classification of the well. Mr. Hertzberg have an office in the detached garage. There is a bathroom in this building but no living quarters. Mr. Hartzberg does not as a rule meet with clients at his office. There are no signs or symbols outside to attract attention to his business, however, there is a" private property, do not enter" sign adjacent to the driveway. The well on this property clearly does not provide potable water to the general public. It is a residential well, not a class BorC. Presently the well is located in a well pit. Mr. Harztberg intend to extend the well casing to above ground level at the same time as the septic system is being up-graded. Tobben~purkland P.E.
