Subject: TANK REPLACEMENT PERMIT & WAVIER REQUEST
Toilsome Hill Lot 1-12601 Toilsome Hill Rd.
Ladies and Gentlemen:
We are submitting an application to upgrade the septic tank for this lot. The existing septic has been
collapsed by a moose. An emergency permit is required to bring the septic system back into service as
soon as possible. The submittal consists of one (1) drawing showing the present improvements on the lot
and the proposed improvements of the lot, of which only the septic tank is subject to this permit
application.
With this submittal we are applying for a waiver of the 100 foot separation distance required between the
septic system and the private wells on Lot 1 Toilsome Hills S/D. The property was developed in 1967.
The existing septic tank was installed when the septic tank setback was 50 feet. Due to the septic tank
cannot be moved outside of the 100 foot well set back.
We were unable to locate a well log for the on lot well. A review of neighboring well logs' indicates that
the wells in the area are drilled into shallow bedrock. Bed rock was observed at depths ranging from 6
feet to 15 feet. According to a well investigation conducted by Ted Moore of Flat Top Technical
Services in 1989, the well has a total depth of approximately 142.5 (MW Drilling) a static water level of
38 feet below the top of the casing, and a production rate of 2.5 gallons per minute (GPM) with a
drawdown of 138 feet. On April 28, 2014 the static water level was observed at 38 feet below the top of
the well casing.
No septic system as -built documentation was located. Per Ted Moore's investigation, the system
consisted of a 1000 gallon septic tank and a concrete crib. On April 25, 2014 the crib monitor tube was
inspected, 9 inches of liquid was observed. The total depth of the crib was 6.4 feet.
Soil logs indicate the following site conditions: a shallow layer of silt/loam; Brown sandy gravel to a
depth of 4 feet, gray silty gravel to a depth of 6 feet, and gravel and sandy gravel to a depth of 13 feet.
Bedrock was observed at a depth of 13 feet. Ground water was not observed during the excavation on
October 13, 1989 or on November 27, 1989.

Mitigating Factors:
A new septic tank is a closed vessel. Subsurface contamination of the ground water is not possible from a
properly installed new septic tank. The new tank will be in improvement over current conditions.
The well head for Lots 1 is located up gradient from the septic tank. If the septic tank were to overflow, it
would drain away from the well head, making surface flow contamination from the septic system
impossible.
The water bearing strata is at a depth of approximately 138 feet, beneath a 100+ foot thick layer of
bedrock. It appears that the water bearing aquifer is confined by this layer. The bed rock should protect
the aquifer from subsurface contamination from the septic system.
The assumed direction of ground water flow is parallel to the existing surface gradient. The surface
slopes away from the on lot well at approximately 35 %, indicating that effluent from the septic tank
would flow away from the well.
We are requesting a waiver for 60 feet between the septic tank and the well.
The installation of this septic tank will not prevent wells and septic systems from being installed on the
adjacent lots. There are no developed or natural surface / sub surface drainage courses within 100 feet of
the proposed septic tank location. The proposed septic tank will not change the general slope of the area.
Ponding and/or concentration of surface runoff will not result from this installation.

By means of this letter I am requesting your issuance of a separation
distance waiver and Health Authority Approval of the water supply and
wastewater disposal systems serving the Brodie residence on Lot I of
Toilsome Hill S/D, located at 12601 Toilsome Hili Road. The septic tank
cleanout is located 64 feet from the well, which was a legal separation
distance at the time of installation. The seepage pit cleanout is located 82
feet from the well, and it is for this seepage pit that I am requesting a
waiver down to 77 feet to allow for possible underground extension towards
the well. I am enclosing a site plan showing the location of the facilities on
the lot, and recent soil test results to assist you in your evaluation.
According to the Municipal Tax Assessor's office, the 3 bedroom
residence on this lot was constructed in 1967, which is prior to Municipal
inspection of water and wastewater systems in this area. The earliest
records in the DHHS files date back to a sale of the property in 1973.
Because the well is so old, there is no well log on file for this lot, nor is there
one on file for the lots to the east or to the west. I am enclosing a well log
for a recent deepening of the well on Lot I A of Lofty Heights S/D, located
approximately 500 feet north of the subject well. The 1973 HAA form cites
a total depth of 120 feet, with 150 feet crossed out. Bill Kranich at MW
Drilling reports that they installed a new pump in the well in the summer of
1988, and their records show a total well depth of 142.5 feet.
On October 9, I conducted adequacy tests of the well and septic system
serving this residence. At the start of my test, the static water level stood at
38 feet below the top of the casing. I ran the pump to draw the water down
to the pump intake at 138 feet, and then measured the recovery rate over
two cycles. Based on measurements made, I determined that the well yield

is 2.5 gpm when fully drawn down. The measured rate slows to 1.5 gpm
when the water level rises to the vicinity of 80 feet. This slowdown in
recovery rate as the water level increases, coupled with the fact that no
water could be heard cascading into the well, leads me to conclude that the
well is being fed from an aquifer located near it's bottom. The well casing
probably terminates at 15 or 20 feet in bedrock, based on soils tests
conducted near the septic system.
Water samples taken on the date of the well yield test showed 3.7
mg/1 of nitrate -N, which is fairly typical of this area, but they also showed 1
coliform bacteria colony per 100 ml. I confirmed the presence of bacteria
with a second sample, after which time I chlorinated the water system. A
third sample taken on November 2, a full week after the system had been
disinfected and flushed, turned up no coliform or other bacteria, indicating
that the well is free of bacterial contamination.
As mentioned above, there is no as -built record of the wastewater
disposal system. In anticipation of a future sale the owner hired Carl's
excavating in the summer of 1988 to install new cleanouts and insulation
over the septic tank and seepage pit. I recently questioned Carl regarding
his recollection of that work, and he reported that the septic tank was a
vertical cylindrical concrete tank which appeared to be in good condition,
and that the seepage pit was constructed of concrete blocks laid on their
sides with a relatively small internal volume. Despite hazardous road
conditions, I was finally able to get Isaac's pumping to pump and measure
the volume of each component of the system on November 22. They
reported that the septic tank has a volume of 1000 gallons, and that they
were able to pump 400 gallons of fluid from the seepage pit. There is no
way to determine the amount or type of sewer gravel backfill surrounding
the seepage pit.
At the start of my adequacy test of the wastewater disposal system on
October 9, the septic tank had 45 inches of fluid in it, and the seepage pit
had 46 inches of fluid with the bottom being 77 inches below ground level.
To test the absorption capability of the seepage pit, I added 127 gallons of
water through the septic tank cleanout, which caused the fluid level in the
pit to rise 11.25 inches and just start to back up into the septic tank. I then
measured the reabsorption rate over two cycles once the flow of water was
stopped, and found an average absorption rate of 1.2 gpm, which is adequate
for a three bedroom residence. I could not observe any evidence that the
system had overflowed in the past, and it is my opinion that the system
continues to be functionally adequate for this residence.
Since there is no record of soils tests conducted at the time of
installation of the system, and due to the known presence of shallow
bedrock in the area, I arranged with S & A Enterprises to bring in a crawler
backhoe to dig a test hole 16 feet away and uphill from the seepage pit
cleanout. The enclosed soil log shows that the subsurface soils consist
predominantly of gravels of different consistencies and degrees of bonding.
The backhoe was able to dig relatively easily to 13 feet, below which level
bedrock was encountered. This log demonstrates that there is the required 6
feet of vertical separation between the bottom of the seepage pit and
bedrock. Despite a very wet fall, no groundwater was encountered in the
test hole, and I verified absence of water in the monitor tube on Nov. 27.
The topography of the lot slopes to the west at 35%. with the well and
septic system being located on opposite sides of the house at nearly the same
elevation, the septic system being slightly lower. Thus there is no possibility
of surface effluent from a failing septic system ever making it to the vicinity
of the wellhead. It is also only logical to conclude that non -vertical
components of subsurface percolation from the seepage pit will parallel the
surface slope, tending to carry effluent away from the well. The silty and
sandy gravel subsurface soils above the bedrock should provide good
filtration and treatment of the effluent. The bedrock itself should provide an
impervious barrier to localized contamination of the well from the septic
system.
The following is a breakdown of the points which could be assigned in
accordance with D.E.C.'s S.C.R.O. separation distance waiver guidelines.

Based on the above analysis, it is my professional opinion that the
requested waiver can be granted without concern as to contamination of the
well from this seepage pit. Please feel free to give me a call if you have any
