Box 770724 Eagle River, Alaska 99577 Re: Glacier View Hts #2, Blockgle RioPlanal Apron to Construct a Wastewater treatment andDisposal System-ADEC Tracking Number 8138 Dear Mr. Eng: On April 14, 2010 the Department received an engineering plan submittal for a onlot wastewater treatment la Bd disposal Treatment tank system th, a new Mo e1�1500 for lon surgetank, followed by the Class BioCycle 1,500 gallon treatment system and a new soil absorption system for the 5 bedroom duplex at the above location. In addition, the existing on-site system will be decommissioned per Appendix K of the Uniform Plumbing Code. The new treatment system will send pressurized effluent out into the disposal system. The disposal system deep trench type has the required 4 feet of cover material and will use an effective trench depth of 5 foot for a length of 37.5 feet or having a 750 ft2 area. The soil is a sandy-gravel. The field percolation test resulted in 2 minutes per inch. As this advanced treatment system is a Category II a safety factor was used and the absorption rate of 2 gallons /ft2 has been determined for an application rate as used above. The Department has reviewed the engineering plans submitted for the advanced onsite wastewater disposal and treatment system and per the Wastewater Regulations 18 AAC 72.235 conditional approval to construct the proposed system is hereby issued. A "Certificate to Construct" for the Duplex served by this domestic wastewater system is enclosed. Please use the referenced plan number in correspondence regarding this system. This approval is contingent upon compliance with the following conditions: 1) If the applicant fails to construct, alter, install, or modify the system within two (2) years after the date that the department issues an approval to construct, the approval is void, and plans must be resubmitted, (along with associated fees), for department review and approval. 2) Deviations from approved plans which affect capacity, flow, operation, major design of units, point of discharge, materials of major system components (such as pipe, lagoon liners, etc.), or separation distances, must be approved by DEC in writing prior to their implementation. 3) This approval is contingent upon compliance with the conditions of Wastewater Disposal Regulations, 18 AAC 72.235, Construction Certification. The noted section of the regulations requires that a Certification of Construction" be completed and submitted to the Department within ninety (90) days of completion of construction. As- built plans or record drawings should indicate any changes or deviations from the approved plans to facilitate final review. A "Certification of Construction" form is enclosed for your use. 4) This approval is contingent upon your receipt of any other state, federal or local authorizations which are required for your project. You are required to obtain all other necessary authorizations before proceeding with your project. 5) You are advised that if this development will require placing fill in wetlands or working in a stream, river, or lake, permits from the U.S. Army Corps of Engineers and the Alaska Department of Natural Resources may be required. A Coastal Projects Questionnaire will help you identify other permits and approvals that may be required for your project. This approval does not imply the granting of additional authorizations nor obligate any state, federal or local regulatory body to grant required authorizations. Any person who disagrees with this decision may request an adjudicatory hearing in accordance with 18 AAC 15. 195- 18 AAC 15.340 or an informal review by the Division Director in accordance with 18 AAC 15.185. Informal review requests must be delivered to the Division Director, 555 Cordova Street, Anchorage, Alaska 99501, within 15 days of receiving the decision. Maintenance, Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. Vi It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically$400 to $600). 14, Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. lt,7 Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system,or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement.
