sewer system has expired as of December 31, 1985.
Permits are issued on a calendar year basis by authority of Municipal
Ordinance. A new permit must be obtained from this Department for any
well and/or on-site sewer system not installed by the expiration date.
If you have drilled the well, a well log needs to be sent to this
Department for documentation of the installation and to close the permit.
If a private engineer inspected the installation of the cn-site sewer system
the original as -built inspection report(three part form) must be sent to
this office for review and approval,and for documentation.

Installing A Septic Sy>tem Wit3out First Obtaining
A Permit From This Department
Dear Sir,
Recently this department received a complaint alleging that
an illegal septic system had been installed on the subject
property. Investigation revealed the presence of several
stand pipes in the area which would indicate that the com-
plaint was valid.
During my telephone conversation with you on August 10, 1979,
you stated that you had installed a 2,000 gallon holding
tank on the subject property. In checking our files, we
have rio records of a permit being issued for the installa-
tion of a septic system on that property. This action is a
violation of Municipal Ordinance 15.65.040 (A) and must be
corrected.
You are hereby notified to take the following action to
correct the existing violation:
1. Obtain written authorization to install a holding
tank from the Department of Environmental Conser-
vation.
2. Obtain a permit from this office and expose the
existing system for inspection by this department.
If the violation referred to herein has not been corrected
by August 30, 1979, legal proceedings may be initiated as
provided by law.

Dear Mr. Gwartney:
I have discussed the matter of your holding tank in Girdwood
with the Office of the Attorney General. Based on a careful
review of applicable law it appears there is no way we can
allow your holding tank to exist contrary to state regulations.
The department is in the process of revising the applicable
regulations and the situation may be different in 1980 when they
will probable be adopted.
I apologize for the long process which has resulted in this -
negative finding.

Dear Mr. Gwartney:
The department has denied your application to install a
holding tank on the subject property because you have not
demonstrated that it will meet all applicable criteria.
Specifically, in light of holding tanks only being allowed
under very restrictive conditions, the department has good
cause to believe that your proposed holding tank will not
comply with 18 AAC 72.020 (e) (1) and (2) which require
that holding tanks be allowed only if permafrost precludes
the use of a conventional wastewater disposal system or
that a replacement System cannot be put on the lot due to
lot size. A copy of 18 AAC 72, Wastewater Disposal is at-
tached for your use.
You have a right to an adjudicatory hearing to contest the
department's denial. A request for an adjudicatory hearing
must be made within 30 days of receipt of this letter by
mailing or delivering a statement of issues to the Alaska
Department of Environmental Conservation, Pouch 0, Juneau,
Alaska 99811. The statement of issues must state the basis
for the hearing request and otherwise conform with AS 44.62.370.
A failure to request a hearing within 30 days of receipt of
this letter constitutes a waiver of your right to administra-
tive or judicial review of this action.
